FLEXIBLE APPOINTMENTS. DEFINITION -100 Flexible appointments are appointments of employees which provide between 75% and 92% time equivalent salary over a calendar year, with some benefit coverages equivalent to full -time appointments. A flexible appointment is a voluntary commitment by an employee to a specific schedule of work. There are two types of flexible appo intments: -101 As with any bargaining unit position, job demands may require work outside (overtime pay may be granted in accordance with the overtime provision) and in addition to those of the regularly scheduled flexible schedule. -102 Where a Type 1 flexible appointment includes a leave with benefits, the employee's position is held for his/her return at the end of the flex -leave, subject to the conditions specified below. -103 The objective of flex -year appointments is to achieve budget flexibility where departmental functions can be accomplished with 75% employment, through a combination of benefits and other incentives. -104 Departments identify positions for flexible appointments. Regular employees, and persons to be employed in those pre-identified positions, may agree to be placed in flexible appointments. Employees desiring flexible appointments, but whose positions are necessarily full -time may apply for transfers to flexible appointments, GENERAL PROVISIONS FLEXIBLE POSITIONS -105 The department administrator shall identify the positions appropriate for flexible appointments, and, if specific duties are to be eliminated, indicate in writing the duties of such positions which are to be eliminated. T his designation must be approved by the Director of Human Resources, after receiving employee input. -106 Once a position is officially designated as flexible, only flexible appointments are acceptable. -107 A flexible position shall maintain that design ation until the departmental administrator acts to designate it otherwise by submitting the appropriate form for the approval of the Director of Human Resources. FLEXIBLE APPOINTMENTS. 202 Flexible appointments are appointments of Administrative Professional staff providing between 75 and 95 percent time equivalent salary over a calendar year, with some fringe benefits equivalent to full-time appointments. A flexible appointment is a voluntary commitment by an Employee to a specific schedule of work. Flexible appointments may be in one of the following forms: Type 1: Full-time, active employment for 9, 10 or 11 months per year with a prescheduled unpaid leave of absence with benefits ("flex-leave") during the remaining months. -203 As with any Administrative Professional position, job demands may require work outside and in addition to those of the regularly scheduled flexible schedule. -204 Where a Type 1 flexible appointment includes a leave with benefits, the Employee's position is held for his/her return at the end of the flex-leave, subject to the conditions specified in paragraph 230. -205 The objective of flex-year appointments is to achieve budget flexibility where departmental functions can be accomplished with 75 percent employment, through a combination of benefits and other incentives. -206 Departments identify positions for flexible appointments. Regular Employees and persons to be employed in those pre-identified positions may agree to be placed in flexible appointments. When a department desires to change a position from full time to a flexible appointment and the incumbent does not volunteer for that status, reduction in force procedures may be initiated to achieve the reduction within the department. If a flexible appointment position is subsequently eliminated, reduction in force procedures will be initiated. Staff members with flexible appointments who later desire a change in appointment may apply for other positions as they become available.

For example, if the FTE salary is $12,000, base salary at 75 percent would be: Type 1: $1,000 x 9 months = $9,000; Type 2: $750 x 12 months = $9,000 -214 Flexible appointees are regular AP Employees. -215 Leaves with benefits may be established for periods of one month or more, up to a maximum of three months (in increments of one month). -216 Leaves with benefits are only those that are prearranged as part of an approved flexible appointment. -217 No Unemployment Compensation is paid during a leave with benefits.1 -218 If the flexible appointment converts to full-time status, the Employee will receive an appropriate salary adjustment. 1Inasmuch as appointees on flex-leave have neither been laid off nor terminated but are on a mutually agreed-upon leave of absence, they are ineligible for Unemployment Compensation. If Unemployment Compensation is sought by the Employee, the leave with benefits is voided and the Employee shall be placed on layoff status, without application of reduction in force provisions. -219 Employees volunteering for flex-leaves must sign the PAN form signifying their voluntary concurrence with their change in status.   • Term Appointments 1.02.1 A term appointment is one in which the beginning and end dates of employment are clearly identified in the appointment letter. 1.02.2 It is agreed that employees employed on term appointments (hereinafter referred to as term employees) are covered by the terms of this Collective Agreement except for those Articles and conditions set out below: a) It is agreed that there is no guarantee or commitment of employment to an employee beyond that which is identified in their appointment letter. b) Term appointments normally are from 3 months to 1 year in length, though such an appointment may be for a longer period under special circumstances such as, Long Term Disability, Family Leave or Leave of Absence. c) Prior to hiring or renewing an employee on a term appointment, Human Resources staff will evaluate a job description submitted by the Department Head/Designate and determine the appropriate salary range and hiring salary in accordance with the Salary Administration provision of this Agreement. If the original appointment letter indicates a period of employment of more than 12 months, or if the employee's actual period of employment in the same position exceeds 12 months, the position description will be submitted for evaluation by the Joint Technical Position Evaluation Committee at the beginning of the thirteenth month of employment. If this evaluation results in a salary increase, the increase shall be made effective to the beginning of the thirteenth month of employment. d) Notwithstanding Article 21.01, term appointments of 3 to 6 months duration will not normally be posted; however, written notice will be sent to the Union. e) For the purposes of seniority, term employees will not be considered as new employees if they are rehired within 6 months of a previous termination. f) Notwithstanding Article 17 (Sick Leave), term employees shall be entitled to accumulate paid sick leave determined at the rate of 2 days per calendar month of their appointment to a maximum of 60 days. g) Notwithstanding Article 12 (Layoff and Recall), in the event of a layoff the University will provide as much advance notice as possible to term employees. However, term employees shall not be entitled to recall rights. h) Term employees shall not be covered by the following articles or clauses of the Collective Agreement: Article 12, Article 17.01, Article 17.02, Article 21.05. i) Term employees whose employment has been renewed beyond the original term appointment, and whose appointment will not be renewed again, will be given a minimum of 2 weeks’ notice or notice pursuant to the Employment Standards Act, whichever is greater, confirming the end date stated in their subsequent appointment letter. j) Term employees who are laid off are entitled to severance pay in accordance with Appendix B, Chart B.

  • Continuing Appointment A continuing appointment shall continue until retirement or until otherwise terminated pursuant to this Agreement.

  • SUPPLIER'S APPOINTMENT The Authority hereby appoints the Supplier as a potential provider of the Services and the Supplier shall be eligible to be considered for the award of Orders for such Services by the Authority and Other Contracting Bodies during the Term and in consideration of the Supplier agreeing to enter into this Framework Agreement and to perform its obligations under it the Authority agrees to pay and the Supplier agrees to accept on the signing of this Framework Agreement the sum of one (£1.00) pound sterling (receipt of which is hereby acknowledged by the Supplier).

  • Medical Appointments Medical appointments may be charged to sick leave, provided the minimum time charged is not less than one-half (1/2) hour. Each absence shall be reported separately and authorized in advance by the employee's immediate supervisor.

  • Initial Appointments The Company appoints the Trustee as the initial Paying Agent, the initial Registrar and the initial Conversion Agent.
