UTILITIES & MAINTENANCE. Lessee shall maintain the following utilities at the Premises: electricity and/or gas, water and sewer service, and trash. UTILITIES & MAINTENANCE. Lessee shall provide and pay for all telephone, cable and electricity separately metered to the Leased Premises. Additionally, Lessee shall pay a percentage share of the County’s costs for utilities and maintenance (“Common Area Expenses) including costs and expenses incurred by the County, in operating, managing, policing, insuring, servicing, decorating, repairing, maintaining and replacing the (a) Common Area, (b) the exterior surfaces of exterior walls, elevator, roofs, foundations, and other structural portions of the Building from time to time, and the basic plumbing, heating, ventilation, air conditioning, sprinkler and electrical systems within the core of such building; and (c) the Common Utility Facilities, including but not limited to sanitary sewer lines and systems, gas lines and systems, water lines and systems, fire protection lines and systems, electrical power, telephone and communication lines and systems. Common Area Expenses shall include the following: expenses for maintenance, landscaping, snow removal, repaving, resurfacing, repairs, replacements, painting, lighting, cleaning, compost recycling and trash removal services, security, if any, fire protection and similar items; expenses related to the Common Utility Facilities; costs of insurance maintained by the County; costs of improvements to the Common Area (i) intended to reduce operating expenses, (ii) as any laws, ordinances, rules, or regulations of any governmental authority or agency having jurisdiction thereover may require from time to time by, or (iii) for the refurbishment and replacement of Common Area improvements or amenities. The percentage of Xxxxxx's share of the County's costs is the proportional share of square footage of the premises rented by Lessee (3,335 square feet) to the rentable square footage of the entire Building (14,824 square feet), being 22.5% of the rentable area of the entire Building, (hereinafter referred to as "pro-rata share"). These charges are based on actual amounts and will be invoiced quarterly to the Lessee.

Tenants are not allowed to deduct from the Rent any expenses for repairs, unless approved in writing by Agent. In the event a condominium association or homeowner's association is currently providing any services to the unit such as cable, satellite TV, alarm monitoring, internet, water, sewer, trash, guarded security gate or other services, and the association decides these services will no longer be provided, Xxxxxx agrees and understands that Landlord and/or Agent shall not be required to replace, provide or pay for these removed services for Tenant. Tenant may opt to pay for non-essential services, but shall be required to pay for essential services including but not limited to water, sewer and trash, if the association no longer provides these services. The discontinuation of any such services by the association shall not be construed as a prohibited practice by Landlord or Agent, nor shall it constitute a default under the lease. The failure of Tenant to retain and pay for essential services upon notice and demand by the Landlord or Agent shall constitute a material breach of the lease. All other utilities and services will be at the Tenant's expense. Resident's Handbook is a part of this Rental Agreement and all requirements contained therein should be considered a part of this Rental Agreement.
UTILITIES & MAINTENANCE. Tenant shall pay $500.00 per month, during the Term, commencing on the Commencement Date, for utilities, including Electric and Gas Service. Such monthly payments shall be deemed "Additional Rent". Owner shall maintain the Building, Building HVAC system, the Building sprinkler alarm service, Building ground and structural maintenance (except interior window glass), and Owner shall perform common area cleaning, and Tenant shall not be obligated to pay any share of the cost thereof; it being understood and agreed that such costs are included in Fixed Rent. Tenant agrees to maintain the interior of the Premises in good repair. Tenant shall be liable for any damage to the Premises or the Building or the mechanical systems caused by Tenant or its contractors, agents and/or invitees, normal wear and tear excepted. If Tenant fails reasonably to cure a default, Owner may do so for Tenant and charge Tenant the reasonable cost thereof, plus interest as provided in subparagraph 2(d). Tenant shall not engage in any activity which would prevent nearby tenants from having the quiet enjoyment of their premises. Tenant shall comply with the Rules and Regulations set forth in EXHIBIT "A" or as reasonably promulgated by Owner for the Building.

UTILITIES & MAINTENANCE. Tenant acknowledges and agrees that Landlord is NOT responsible for providing Tenant with electric, water, sewer, heating and air conditioning, telephone, cable, internet, waste disposal, or other utility service. Tenant is responsible for setting up its own account with, and directly paying the cost of services to, the proper utility companies. Tenant shall also be responsible for keeping the exterior of the Premises in a sightly condition, and shall be responsible for mowing the lawn, snow removal, and any other landscaping work on the Premises.

UTILITIES & MAINTENANCE. During the Term, (a) Tenant shall arrange and pay for all public utility services used on the Premises by Tenant, and (b) subject to Section 9(b) below, Tenant shall be responsible for the repair and maintenance of the entire Premises within the fenced area. Notwithstanding anything contained herein to the contrary, Landlord shall be responsible for providing tie-in access, at reasonable and appropriate locations at the boundary line(s) of the Premises for any basic utilities to the Premises, and Tenant will be responsible for installing or arranging for the installation, at its cost, of any connections for such basic utilities from such tie-in points to the applicable Tenant Improvements.
