Road Maintenance. Purchaser shall maintain roads, commensurate with Purchaser’s use, in accor- dance with Road Maintenance Requirements in C5.31 and the Road Maintenance Specifications. Performance of road maintenance work by Purchaser may be required prior to, during, or after each period of use. The timing of work accomplishment shall be based on Purchaser’s Op- erating Schedule under B6.31. When two or more commercial users are simultane- ously using the same road where Forest Service is not requiring maintenance deposits, the commercial users will develop maintenance responsibilities and arrangements for accomplishing the work. Forest Service must agree to this plan. If the commercial users cannot agree on main- tenance responsibilities, Forest Service shall resolve the differences. If Purchaser elects to use different roads than those listed in C5.31, Forest Service shall determine Pur- chaser’s commensurate share of road maintenance and revise road maintenance deposits in C5.32. If Forest Service cannot perform its full commensu- rate share of road maintenance, Forest Service shall make a cash payment to Purchaser for performance of such work. Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordi- nary nature.

Road Maintenance. PURCHASER is responsible for normal road maintenance on roads used for any activity under this contract. Normal road maintenance shall provide for safe forest driving conditions, continuous access and road use, protection of roads from damage, water quality, and compliance with all applicable laws. PURCHASER’s responsibility for normal road maintenance commences with PURCHASER’s first use of a road for any activity under the contract period and shall continue through any active periods until final acceptance of the maintenance is made by STATE. In addition, during active periods, PURCHASER is responsible for normal road maintenance needs that are caused by public use of the roads. Should PURCHASER jointly use the road with other parties authorized under Section 41 to use the roads, each party shall be responsible for a proportionate part of normal maintenance, based upon the ratio of each party’s use to total road use, as determined by STATE. STATE may determine when maintenance is needed and issue instructions to PURCHASER specifying work to be done and the date it must be completed. Normal road maintenance shall be inclusive of PURCHASER action needed to prevent and protect the road from seasonal weather damage, repair damage caused by road use, and restore the road to at least the road condition at commencement of use, including, but not limited to:

Road Maintenance. DESIGNATED MAINTAINER Purchaser may be required to perform maintenance on roads listed in Contract Clause C‐060 DESIGNATED ROAD MAINTAINER as directed by the Contract Administrator. Purchaser shall maintain roads in accordance with FOREST ACCESS ROAD MAINTENANCE SPECIFICATIONS.
Road Maintenance. 4.1 At the date of execution of this Agreement, the Xxxxx Xxxxxxxxxxxx xx Xxxxxx #000 has agreed to provide gravel road maintenance. The Developer makes no representations or warranties that such services will be provided indefinitely.
Road Maintenance. Contractor shall perform or pay for road maintenance work, commensurate with Contractor's use, on roads controlled by Forest Service, and used by Contractor in connection with this contract. Road maintenance requirements are based on the predicted haul route. Any change in the Contractor's actual haul route may necessitate a change in the roads to be maintained and/or in the amount of required deposit for road maintenance. Required deposits for road maintenance are listed in provision K(T)- F(T).3.2# in the sample contract. Maintenance specifications are in the sample contract.
Road Maintenance. Lessee agrees to maintain all the field roads and trails on the Premises in good and passable condition in accordance with Alabama’s Best Management Practices for Forestry published by the Alabama Forestry Commission and any requirement of the Alabama Department of Conservation. Lessee will refrain from using said field roads and trails for vehicular traffic during periods of wet weather. Lessee will drain and fill all "wet" places in the roads and trails, maintain waterbars, and otherwise prevent erosion. No new roadways, trails, or other travel ways shall be cleared, constructed, or improved on the Premises except on the express written approval of the Lessor. All roads constructed by Lessee (except any lost through reclamation) shall become the property of the State. All roads constructed or used shall be left in good condition with proper provisions made for drainage and runoff.

Road Maintenance. The District agrees to provide minimal road maintenance on graveled access roads, as they currently exist, located on the District's property which provide access to the Leased Premises, such maintenance to include not less than graveling and grading annually. Snow removal will not be provided.
Road Maintenance. The Developer will be responsible for the maintenance of the roads until the Certificate of Final Acceptance has been issued. Summer maintenance shall include grading, dust control and general clean-up of the site. Winter road maintenance shall include all plowing, sanding and salting to assure proper vehicular access within the Lands constituting the Plan. In the event that proper maintenance or snow removal is not provided by the developer, the Municipality, through its servants, contractors or agents may provide maintenance and/or remove snow without notice to the Developer. Such work will be carried out at times deemed to be an emergency by the Municipality’s Road Superintendent. All costs of such work shall be paid by the Developer within thirty (30) days of date of billing or otherwise may be deducted from the Deposited Securities. The Developer further agrees that any work done by the Municipality pursuant to this Agreement before the roads are accepted by the Municipality shall not be deemed in any way, to be an acceptance by the Municipality of the roads with the Plan upon which such work is completed. The Developer acknowledges that the Municipality, in providing maintenance or during snow removal, may damage or interfere with the works of the Developer and cause damage to such works and the Developer hereby waives all claims against the Municipality that he might have arising therefrom and covenants that he will make no claim against the Municipality for such interference or damage. Representation may be made requesting that the Municipality consider entering into a separate Agreement with the Developer to undertake the winter road maintenance for the roads located within the Plan.
Road Maintenance. The Manager shall be responsible for the maintenance and upkeep of all roads servicing the closed landfills including but not limited to repair and reconstruction as necessary, maintenance of roadside ditches and other drainage systems, maintenance of all gates and fencing, construction of new service roads if necessary, dust control as necessary, and snow plowing.
