Loss of Recall Rights in Home Plant. If an employee loses their recall rights to their home plant, the preferential hire plant now becomes the home plant. They will keep their credited service for pension, vacation, etc. This does not affect the seniority date, which remains the date of entry to the preferential hiring plant.

Loss of Recall Rights in Home Plant.  If an employee loses their recall rights to their home plant, the preferential hire plant now becomes the home plant and they will keep their credited service for pension, (except as amended for Lakeshore) vacation, etc. This does not affect the seniority date, that remains the date of entry they had when they were hired as “preferential hire” employees.  Upon an employee accepting employment at the hiring plant, the Employer and the Employee will have a thirty (30) day trial period to determine if the Employee is able to perform the work at the new facility. If during the thirty (30) day evaluation period, the Employee determines they do not wish to continue their employment at the new facility they must provide the Employer with written notice of their intention to resign a minimum of two (2) weeks prior to their last day worked. Provided the Employee submits their notice of intention to resign within the thirty (30) calendar day period, the Employee will be laid off and placed back in to the Preferential Hiring Pool, in accordance with their seniority.  If during the thirty (30) day evaluation period, an Employee fails to provide two (2) weeks notice or submits notice after the thirty (30) day trial period, the Employee will be deemed to have voluntarily terminated their employment and will be placed at the bottom of the ‘Preferential Hiring Pool” for ninety (90) calendar days, after which time they will be placed on the “Preferential Hiring Pool” in accordance with their seniority.  The parties agree that during the thirty (30) day evaluation period, preferential hired employees will not be entitled to use any of the PPH days, boot allowance or other monetary benefits of the new plant. Following the thirty (30) day trial period, such employees will be entitled to all benefits of the new plant provided that this is the agreement they are working under. During the thirty (30) day evaluation period, employees will be entitled to the benefits of their home plant.  If an Employee is required to attend an orientation-training program prior to commencing employment, the Employer will reimburse the employee for the hours spent during the orientation-training period.  An Employee who accepts full time employment through the “Preferential Hiring Pool” will be obligated to accept a recall to their home plant or they will forfeit their recall rights.   • 341 Prevention of Oil Spills If Purchaser maintains storage facilities for oil or oil products on Sale Area, Purchaser shall take appropriate preventive measures to ensure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual States. If the total oil or oil products storage exceeds 1,320 gallons in containers of 55 gallons or greater, Purchaser shall prepare a Spill Prevention Control and Countermeasures Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer.   • LOSS OF PERSONAL PROPERTY The board will not be responsible for any employee’s loss of personal property brought to a school or work site; however, in the event an employee’s personal property is lost or damaged as a direct result of a disaster, such as hurricane, fire, flood, etc., the board will reimburse the employee’s loss or damage in an amount not to exceed $500 per occurrence. In order for an employee to be eligible for such reimbursement, the personal property for which the employee makes a claim must have been pre-approved for use by the employee in connection with the employee’s duties, as evidenced by a written approval form signed by the employee’s principal or site supervisor and by the employee. In addition to the approval form, the employee must attach to the form proof of the property’s value, i.e. receipt, etc. The employee will be responsible for presenting a copy of the approval form in order to secure payment for loss. Payment will not be made unless the form is presented. The maximum amount an employee may receive for loss in any single occurrence is a total of $500, regardless of the amount or number of items approved for use in connection with the employee’s duties.

  • Cooperation on Preventing End User Fraud The Parties agree to cooperate fully with one another to investigate, minimize, prevent, and take corrective action in cases of fraud.
