The "Returning to" clause establishes the conditions under which a party or item must be returned to a specified location or state after a particular event or period. Returning to work after a period of parental leave
(a) An employee will notify of their intention to return to work after a period of parental leave at least four weeks prior to the expiration of the leave.
(b) An employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an employee transferred to a safe job pursuant to 6.7.9, the employee will be entitled to return to the position held immediately before the transfer.
(c) Where the position no longer exists but there are other positions available which the employee is qualified for and is capable of performing, the employee will be entitled to a position as nearly comparable in status and pay to that of their former position.
Returning to work after a period of parental leave
(a) An employee will notify of his or her intention to return to work after a period of parental leave at least four weeks prior to the expiration of the leave.
(b) An employee must give at least four weeks’ notice of his or her intention to come back to work before the end of the leave. On returning (or at the end of the notice given) the employee concerned is entitled to his or her previous position or to a position comparable in status and not less salary to his or her previous position. Previous position means the position the employee held before starting leave or if she moved to safe duties under these provisions, the position held by the employee before she moved.

(b) An employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an employee transferred to a safe job pursuant to clause 35.11, the employee will be entitled to return to the position they held immediately before such transfer.
(c) Where such position no longer exists but there are other positions available which the employee is qualified for and is capable of performing, the employee will be entitled to a position as nearly comparable in status and pay to that of their former position.
(d) Where such a position in no longer available, but there are other positions available that the employee is qualified for and is capable of performing, the employer shall make all reasonable attempts to return the employee to a position comparable in status and pay to that of the employee's former position.
