USE OF YOUR ACCOUNT. ACCOUNT USE: You may use Your card, Your Account number or checks, or similar instruments (including electronic form or otherwise) that We send to You (collectively, “Account Access Devices”) to make Purchases and Balance Transfers, and to obtain Cash Advances. Each time You use Your Account, You are representing that You intend, and have the ability, to repay all amounts due. You are responsible for all charges made by anyone You allow to use Your Account, even if they charge more than You intended. If You request that We issue a card or any Account Access Device to another person, You are responsible for all charges incurred by such person until You return their card to Us, or until You notify Us that use of their card or any Account Access Device is no longer authorized, whichever occurs first. We may, in Our discretion and to the extent permitted by law, restrict or refuse any request that We issue a card or any Account Access Device to another party. If unauthorized use of Your Account occurs, You agree to cooperate with law enforcement and Us in identifying the unauthorized user. As permitted by law, We may consider charges made by someone known to You (i.e. family member, relative, significant other, partner, roommate, co-worker, friend) using Your card or any Account Access Device as authorized by You. Each person named on the application for the Account and anyone else authorized to use the Account in any way is jointly and severally liable for all amounts due on this Account. CREDIT LIMIT/AUTHORIZATIONS: Your “Credit Limit” is the maximum amount of credit available under Your Account at any time. We will notify You of Your Credit Limit with Your Account Documents and on Your Billing Statements, and We may change or restrict Your credit availability at any time. You agree not to exceed the established Credit Limit and to pay any amount in excess of Your Credit Limit immediately. We are not obligated to allow the balance of Your Account to exceed its Credit Limit. If Your Account is a joint Account, each of You may request Credit Limit increases subject to applicable law. We may raise or lower Your Credit Limit at Our discretion and may restrict the amount of the Credit Limit available for Cash Advances and Balance Transfers. You may be required to enter your PIN to complete a transaction. You will safeguard your Card and all PINs to prevent unauthorized use.
USE OF YOUR ACCOUNT. If your Card or any Check(s) are lost or stolen or if you have reason to think someone may use your Account without your permission, you must notify us at once. Please telephone us at the number on the back of your Card concerning the loss or theft of your Card or Checks or the possible unauthorized use of your Account. Do not use the Card, Account number or any Checks after they have been reported lost or stolen, even if they are found or returned. You will not be liable for unauthorized use of the Account; however, you must identify for us the charges that were not made by you or someone authorized by you and through which you received no benefit. We may require you to provide us with certain information and to comply with our investigation procedures. We may terminate or limit access to your Account if you have notified us or we have determined that your Card or Checks may have been lost or stolen, or that there may be unauthorized access to your Account. Inquiries or Questions: You may address any inquiries or questions which you have about your Account to Farm Bureau Bank, FSB, by visiting the website on the back of your Card and sending us an e-mail, writing us at Farm Bureau Bank, FSB, X.X. Xxx 00000, Xxx Xxxxxxx, Xxxxx 00000-0000, or calling us at the number on the back of your Card. If you telephone or email us instead of writing, you may lose certain rights the law gives you to dispute billing errors.
USE OF YOUR ACCOUNT. Accounts and transactions subject to this Agreement may be used for lawful purposes only. Transactions reasonably believed by the bank to be used for or associated with unlawful activity may be rejected or stopped and the associated account(s) closed immediately and without prior notice. Unlawful activity forbidden under this Agreement includes, but is not limited to: fraud, money laundering, identity theft, illegal gambling, or other violations of federal, state, and local laws. Obligations owed before any improper transaction or account closure will remain in full force. All liabilities and costs associated with rejected or stopped transactions or closed accounts are assumed by the account holder. Collateralized Accounts. If you hold an account that has been collateralized by the bank with securities, letters of credit or other assets, upon account withdrawal, you relinquish any claim on the collateral associated with the withdrawn balances.
USE OF YOUR ACCOUNT. Your use of the open-end credit offered pursuant to this Agreement, or its use by anyone you authorize, shall constitute acceptance of the terms of this Agreement and the arbitration provision contained in this Agreement. Your use of the Account also acknowledges that you are of legal age to enter into a binding agreement with us. Billing Period. A Billing Period is the interval between monthly billing statements. The Statement Closing Date is the last day of the Billing Period for that statement. Payment. You promise to pay us for all purchases charged to your Account plus any Interest Charges and any other charges that may be assessed as provided in this Agreement. You promise to pay at least the Minimum Payment Due as shown on your billing statement each month by the Payment Due Date. We will advise you of your Payment Due Date each month on your billing statement. Your Payment Due Date will be the same day of the month for each monthly Billing Period and will be at least twenty two (22) days after the close of each Billing Period. Your Minimum Payment Due is the sum of all past due amounts plus the greater of $20.00 or 3% of the New Balance shown on your billing statement, rounded up to the next dollar. At any time we can require you to pay all amounts by which your balance exceeds your Credit Limit. You may pay all or any part of your balance at any time without penalty. When Periodic Interest Charge is Imposed. Interest Charges on purchases will accrue from the shipment date or the in-store purchase date of the product until the date we receive payment in full of the balance on your Account. However, if you paid in full the New Balance from your immediately preceding Billing Period by the Payment Due Date shown on the statement, then: (1) if your Previous Balance was zero (0) and you pay the New Balance for the current Billing Period by the Payment Due Date shown, you will not be charged any Interest Charges; and (2) if you make a payment by the Payment Due Date shown on the current statement that is less than the New Balance, that payment will be credited as of the payment date and interest will be assessed. Periodic Interest Charge. We figure the “Interest Charge” on your Account for any Billing Period by applying the Daily Periodic Rate to the Average Daily Balance of your Account (including new purchases) and multiplying the result by the number of days in the Billing Period.
