Site Operations. The Manager shall monitor and manage each Owner's property rights associated with the Sites, make periodic inspections of the Sites for needed repairs, arrange for all such repairs determined to be necessary or appropriate, and otherwise provide for the maintenance of the Sites, including using commercially reasonable efforts to ensure that Tenants install their equipment in accordance with the terms of the relevant Lease and that all Sites are maintained in compliance in all material respects with any applicable FAA and FCC regulations, the terms of any applicable Ground Lease or Easement and any other applicable laws, rules and regulations. The Manager shall arrange for all utilities, services, equipment and supplies necessary for the management, operation, maintenance and servicing of the Sites in accordance with the terms and conditions of the Leases, the Site Management Agreements and applicable law. All utility contracts shall be in the name of the applicable Owner with all notices to be addressed to such Owner in care of the Manager, at the Manager's address. The Manager shall perform on behalf of each Owner any obligation reasonably required of such Owner pursuant to any Site Management Agreement, agency agreement, or other agreement related to the Sites (other than the payment of amounts due from the Owners thereunder, which payments shall be paid out of the Operating Account as provided herein). If any Owner is obligated to or otherwise undertakes any alterations or improvements to a Site, the Manager shall arrange for such alteration or improvement on the Owner's behalf.
Site Operations. The GRANTEE will be responsible for all aspects of site day-to-day operations of each site. Operations will include property management services, maintenance, repairs, security and landscaping. Operations will also include planning and execution of onsite services. Finally, operations also include development of management plans for the site that addresses: a) security, hours of operation and other property management issues and b) public health and safety related workplace safety protocols as recommended by the Centers for Disease Control and Prevention and Santa Xxxxx Public Health Department.

The Manager shall arrange for all utilities, services, equipment and supplies necessary for the management, operation, maintenance and servicing of the Sites in accordance with the terms and conditions of any applicable ground leases, easements, Leases, site management agreements and similar agreements and applicable law. Site Operations. The operation of the Site shall be in accordance with this Works Specification Clauses 1 to 10; the General Conditions of Contract AS4000; Part A and Part B Annexures of General Conditions of AS4000-1997; and all other Principal supplied documents that form part of this Contract (as listed in Item 15 of Part A Annexure of General Conditions of AS4000-1997). The Contractor is not to undertake any activities that would compromise the intent of the Environmental Management Plan for the site. The site is under rehabilitation with stockpiled soil material to be used for future revegetation/rehabilitation. The Contractor is to undertake rehabilitation works as per Xxxxxx 6 of this Works Specification. The Contractor is to be familiar with and abide by various plans, surveys, regulations and legislation (as listed in Item 15 of Part A Annexure of General Conditions of AS4000-1997) :
Site Operations. If the Services include visit(s) to site(s) by the Consultant’s personnel the Client shall be responsible for the safety of the Consultant’s personnel and the Consultant shall be relieved from performance of the Services whilst it considers the site to be unsafe. The Consultant shall not be deemed to have assumed the role of occupier, or otherwise to have assumed control of or responsibility for a site or personnel on it. If the Consultant is authorised to direct or supervise the work of any others, the Client shall indemnify and hold harmless the Consultant from and against any claims arising therefrom, even to the extent of the Consultant’s negligence. The Consultant shall take reasonable care to minimise damage to property, including utilities and other sub-surface obstructions the likely position of which has been notified to the Consultant (in writing). If, notwithstanding such precautions and endeavours, any such property is damaged, the Client shall indemnify and hold harmless the Consultant from and against all consequences of such event, even to the extent of the Consultant’s negligence.
