Courtesy Pay. In accordance with our commitment to provide valued service and benefits, we may, if you qualify, at our discretion, pay overdrafts that would cause your eligible checking account to have a negative balance up to the amount of your limit, which is determined by us in our sole and absolute discretion. Courtesy Pay is different than the Overdraft Transfer Service. Courtesy Pay is a backup to the Overdraft Transfer Service and will only be activated if funds are not available from the Overdraft Transfer Service.

Courtesy Pay. Courtesy Pay is offered as a courtesy to our members who qualify for this service. Do not rely on Courtesy Pay to pay your items. Courtesy Pay is intended only as a courtesy in the event you accidentally overdraw your account. Courtesy Pay is a standard overdraft practice, included on your Checking Account for checks, recurring debit card transactions, ACH transactions and automatic bill payments made using your Checking Account number, unless you ask us to not use Courtesy Pay for your account for these types of transactions. Courtesy Pay is not offered on Second Chance Checking or to minors. Since we charge a fee, regulations require you to “opt in” for our Optional Courtesy Pay service if you want us to pay your one-time (everyday) debit card transactions and ATM transactions. An “opt in” or “opt out” decision by the member or any joint owner will be treated as binding for all owners on an account. An “opt in” or “opt out” decision is required for each individual checking account. Your ability to “opt in” may be limited or restricted to prevent structured or intended abuse of the program. The amount of the Courtesy Pay fee is set forth in the Truth in Savings Fee Schedule (TIS Fee Schedule). Courtesy Pay can be revoked at our sole and absolute discretion. There are also overdraft protection plans (a link to a 1CFCU Savings, Club (except Christmas club), or a link to a 1CFCU Line of Credit (you must apply and qualify for this account). There are no fees per transfer for the first 6 Regulation D transfers from your available Savings and Club accounts. Subsequent transfers subject to Regulation D from a savings or club account will be charged a fee in accordance with our TIS Fee schedule. See Savings, Club and Money Market AccountLimitation on Preauthorized Transfers. You may link one or more of these overdraft protection accounts to your checking account for overdraft protection. In the event these overdraft protection plans are utilized, we will use our best efforts to transfer available funds from the eligible Savings or Club Account to your Checking Account, or to make an advance of funds under the eligible 1st Cash Line of Credit Agreement to your Checking Account, to remedy the overdraft. Courtesy Pay. Unless you have applied for and received an overdraft line of credit, we do not have to pay your overdrafts. However, if you do not have an overdraft line of credit, or do not want us to overdraw our account under any circumstances even as a courtesy to clear an item that you have written, you must tell us not to do so. You understand that is may be a crime to write a check you know will not be paid. If your account receives a monthly direct deposit benefit check, such as Social Security or VA Disability, from the United States government and you do not want us to use funds in that account to pay an overdraft, you must tell us. If you do not tell us, you consent to allowing us to apply those funds to repay your overdrafts. Our Fee Schedule states the fee charged for paying your overdrafts.

Courtesy Pay. Pursuant to our commitment to provide valued service and benefits, we may pay checks or other items/transactions (“Item” or “Items”), which would cause your business share draft account to have a negative (or further negative) balance (herein “overdraft”), pursuant to the terms and conditions of this Agreement. The Courtesy Pay service is not a loan or other credit product and requires no application or credit approval process. The Courtesy Pay service is for businesses and will only be applied to your business share draft (checking) account(s) if: • You maintain your membership in good standing; • Your business share draft account was opened more than 60 days; • Your business share draft account was funded with at least $1.00 for a period not less than 30 days before the item was presented to ESL for payment; • Your loan and credit card accounts you have with us are current; • Your business share draft account is brought to a positive end-of-day available balance at least once every 20 days; • There are no legal or administrative orders, including attachments, garnishments or levies against your accounts with us; • There are no pending bankruptcies or financial counseling arrangements; • There is no negative balance on any other share account on which you are an owner. ANY SUCH PAYMENT WILL BE MADE ON A CASE BY CASE BASIS, AT OUR SOLE DISCRETION. However, we shall not pay any item if your negative checking account balance is, or if we were to make payment pursuant to this Agreement would become, greater than $500 in a Business Classic Checking Account or $1,000 in a Business Premier or Business Analyzed Checking Account excluding any applicable fees. You will be notified of any nonsufficient funds Item that has been paid or returned; however, you understand that ESL has no obligation to notify you before we pay or return any item. We may refuse to pay any overdrafts without first notifying you even though your account is in good standing and even if we have paid previous overdrafts. For any overdrafts created, you promise to pay us upon demand all sums, including the fees and charges for this service, advanced to you or any other person you permit to use your business share draft account and who causes an overdraft on your share draft account. Courtesy Pay. We are not obligated to pay any item presented for payment if your account does not contain sufficient available funds, and any payment by us of any non-sufficient funds check or preauthorized transaction processed through the Automated Clearing House network is at our discretion and does not obligate us to pay any additional non-sufficient fund item or to give advance notice of our decision to refuse to pay a similar item. We will consider, as a discretionary courtesy and not a right or obligation, approving your reasonable overdraft checks and preauthorized transactions processed through the Automated Clearing House network. The privilege will not be used to pay ATM or Debit MasterCard Transactions. Any and all fees and charges, including without limitation, the non-sufficient funds fees as set forth in our Service Charge Schedule for Consumer Accounts will be included. The total of the discretionary courtesy overdraft (negative) balance, including any and all fees and charges, including all non-sufficient funds/overdraft fees, and continuous overdraft fees is due and payable upon demand, and each account owner will continue to be liable, jointly and severally, for all such amounts.

The Credit Union offers two Courtesy Pay options for your checking account: Courtesy Pay coverage for your Checks, ACH, and recurring Debit Transactions Courtesy Pay coverage for your Checks, ACH, recurring Debit transactions, ATM transactions, and Debit Card purchases. If you opt-in to Courtesy Pay coverage for your Checks, ACH, and recurring Debit Transactions, you can elect to additionally opt-in to coverage for your one-time ATM transactions and Debit Card purchases. If you elect to opt-out of Courtesy Pay coverage for your Checks, ACH, and recurring Debit Card transactions, you will not have the option to opt-in to coverage for your one-time ATM transactions and Debit Card purchases. Courtesy Pay. The Courtesy Pay program is a service CCFCU offers to eligible members that will provide a limited amount of overdraft protection from which CCFCU may authorize and pay checks, ACH/electronic items and everyday debit card transactions (subject to certain requirements applicable to debit card transactions) initiated for payment against your eligible checking limit when account funds are not available. That means, instead of returning your check, ACH/electronic item and everyday debit card transactions, we will pay the item (subject to certain requirements applicable to debit card transactions) saving you additional charges from merchants as well as the embarrassment of an overdraft.
Courtesy Pay. Except as otherwise agreed in writing, if we exercise our right to use our discretion to pay an overdraft through the Courtesy Pay program, we do not agree to pay overdrafts under said program in the future and may discontinue covering overdrafts at any time without notice. If we pay an overdraft through the Courtesy Pay program and impose a fee that overdraws your account, you agree to pay the overdrawn amount in accordance with the Courtesy Pay program. There is a per item fee for overdraft created by checks, in person withdrawals, ATM withdrawals, or by other electronic means as applicable. Courtesy Pay. We will consider, as a discretionary courtesy and not a right or obligation, approving and paying your reasonable overdrafts for a fee. If we choose to pay your items, your account will be brought to a negative balance and presented items will be honored. The account must be brought back to a positive balance within a specifed period of time. If the account is not brought back to a positive balance in the stated time period, the Courtesy Pay service can be discontinued or the account closed. Approved Courtesy Pay limits may vary depending on the status of a qualifying direct deposit. All applicable fees and charges, including the non-sufcient fund/overdraft fees, will be included in this limit. A separate opt-in agreement is required for Courtesy Pay Plus to cover ATM and everyday debit transactions. The following scenarios are ofered to help you understand Available Balance, Actual Balance and the fees that can be incurred. They are for demonstration only and not inclusive of all possible scenarios that may apply to you.
