Excessive Use. 4.11 If Your use of the Services is deemed by Us to be in excess of that which is normal for the Service which You have purchased, We may at Our discretion require You to move onto another Service which is more suitable for Your requirements.

Excessive Use. 4.1 You must use your Service in accordance with any download or capacity limits stated in the specific plan that you subscribe to for the use of that Service. We may limit, suspend or terminate your Internet Service if you unreasonably exceed such limits or excessively use the capacity or resources of our Network in a manner which may hinder or prevent us from providing services to other customers or which may pose a threat to the integrity of our Network or systems.
Excessive Use. In the event that any lights, machinery, or equipment, including but not limited to, computers and servers, used by Operator in the Facilities materially affects the temperature otherwise maintained in the Facilities, or if Operator’s use of the Facilities results in Services being used in excess of that which is reasonable and customary for a similarly operated school in a building owned by IPS of a similar age and condition with an academic program substantially similar to the School’s academic program, the costs of such excess Services as determined by IPS, acting reasonably and in good faith, shall be charged to Operator and shall be due to IPS within thirty (30) days of written invoice for such service. If IPS reasonably determines that Operator’s use of the School resulted in electrical, gas, water, or sewage usage that can be shown to exceed the usage at comparable schools operated by the IPS, with an academic program substantially similar to the School’s academic program, IPS shall be entitled to install, at Operator’s expense, meters, submeters, or other measuring devices to determine the consumption of such Services in the Facilities.
Excessive Use. In the event that Operator’s use of the Facilities results in Services being used in excess of that which is reasonable and customary for a similarly operated school in a building owned by IPS of a similar age and condition with an academic program substantially similar to the School’s academic program, IPS shall provide to Operator written notice of such excessive use, which shall include an explanation as to why IPS contends the use is excessive. If such excessive use by Operator is not discontinued within 30 days after Operator receives such notice, IPS may charge Operator for the costs of such excess Services as determined by IPS, acting reasonably and in good faith, with payment due to IPS within 30 days of Operator’s receipt of the written invoice for such Services. If IPS reasonably determines that Operator’s use of the School resulted in electrical, gas, water, or sewage usage that can be shown to exceed the usage at comparable schools operated by the IPS, with an academic program substantially similar to the School’s academic program, IPS shall be entitled to install, at Operator’s expense, meters, submeters, or other measuring devices to determine the consumption of such Services in the Facilities.
Excessive Use. We may monitor your use of the Silverline SaaS Offerings for Excessive Use. If your usage of the Silverline SaaS Offerings is deemed Excessive Use, as measured by us, you will (i) negotiate in good faith with us to increase the capacity of such Silverline SaaS Offerings to cover such Excessive Use, and (ii) place additional orders for the applicable Silverline SaaS Offering to remedy the Excessive Use.
Excessive Use. For purposes of this Service-Specific Term, “Excessive Use” means your usage of the Silverline Web Application Firewall Service (a) in excess of the bandwidth provided for in the applicable Order, as measured by us where use shall be excessive if either (i) the 95th Percentile Calculated Bandwidth exceeds the applicable tier defined in the Order; or (ii) you are targeted by a sustained DDoS attack whereby your application consumes more than one DDoS attack that exceeds a peak of 1.5 Gbps of attack traffic during any twelve (12) month period, unless you have an effective subscription to Silverline DDoS Protection SaaS Offerings covering such attack or (b) where you have provisioned a quantity of FQDNs for protection via the Silverline Web Application Firewall Service greater than the defined amount of FQDNs in the Order. You acknowledge and agree that our obligations are limited to providing the Silverline Web Application Firewall SaaS Offerings in the quantiles identified in the Order(s) for the active Service Term(s).
Excessive Use. You shall monitor and maintain Your accounts within all plan-specified limits and in a manner that does not disrupt the activities of other PLEX customers. In the event Your usage exceeds the limits for Your account or may disrupt the activities of other PLEX customers, You agree PLEX may, in its sole discretion, (i) charge You for such excess usage via Your credit card, or by invoice, (ii) upgrade You to a plan or increase the limits on Your account to address this excess usage, and/or (iii) suspend or terminate Your account for cause. Usage and associated charges for excess usage shall be determined based solely upon PLEX's collected usage information. Unused monthly allotments shall not accrue or carry over from one month to any other month. Upon any upgrade or increase on the limits of Your Account, You shall be responsible for the new costs and fees.

Excessive Use. For the purpose of this Service-^ƉĞĐŝĨŝEĐxc essdiveĞUƌseŵ͕͟ ŵ͞ĞĂŶƐ LJŽƵƌ ƵƐĂŐĞ Silverline DDoS Protection Service in (a) excess of the Clean Bandwidth as measured by 95th Percentile Calculated Bandwidth; or (b) your configuration of Router Monitoring or Data Centers (e.g., GRE Tunnels) exceeds the quantities defined in the applicable Order.

Excessive Use. The Company retains the right to charge a fee of up to $150 per hour for excessive use of the support line by Merchant. Written notice will be provided prior to any excessive use charges being levied.
