Staffing Changes. The Director’s prior written approval is required for the Consultant to remove, replace or add to any of its staffing identified in Attachment B of an Approved Service Order.
Staffing Changes a. The Network Service Provider shall comply with their staffing plan contained in the Managing Entity-approved Exhibit C - Projected Operating and Capital Budget, Exhibit D - Personnel Detail Record, and Exhibit E - Agency Capacity Report.
b. The Network Service Provider shall, within five business days, submit written notification to the Network Manager if any of the following positions are to be changed and identify the individual and qualifications of the successor:
(1) Chief Executive Officer (CEO);
(2) Chief Operations Officer (COO);
(3) Chief Financial Officer (CFO);
(4) Chief Information Technology Officer (CITO); or
(5) Any other equivalent position within the Network Service Provider’s organizational chart.
Staffing Changes. In the event the Hospital proposes a change in the RN staffing (including but not limited to, changes in nurse/patient ratios or clinical staff mix) on any unit other than temporary adjustments, the Hospital shall comply with the following procedures.
5.10.2.1 The Hospital will provide written notification to the Association and the Local Unit Chairperson(s) of the proposed changes a minimum of twenty-one (21) days prior to the proposed date of implementation. Such notice shall include the nature of the staffing change, the basis for the staffing change and the time line for implementation.
5.10.2.2 If requested, the Conference Committee shall convene as soon as possible following receipt of the notice to review the proposed staffing changes and provide input related to those changes prior to implementation. Notice of the Conference Committee meeting will be posted on each affected unit inviting interested nurses to attend the meeting. There will be a post-implementation evaluation process agreed on with regular reports to the Conference Committee.

The Contractor shall notify DCH in the event of any changes to key staff, including the Executive Administrator, Medical Director, Quality Improvement/Utilization Director, Management Information Systems Director, and Chief Financial Officer. The Contractor shall replace any of the key staff with a person of equivalent experience, knowledge and talent. This notification shall take place within five (5) business days of the resignation/termination.
Staffing Changes. Contractor shall provide, to SCA and the affected court, notice of the names of attorneys who are hired or leave Contractor's employ and any other substantial staffing changes. Upon request by SCA, Contractor shall provide a current list of attorneys and staff positions by full time equivalent.
Staffing Changes. 14.2.1 The Contractor shall notify DCH in the event of any changes to key staff, including the Executive Administrator, Medical Director, Quality Improvement/Utilization Director, Management Information Systems Director, and Chief Financial Officer. 14.2.2 DCH also may require the removal or reassignment of any Contractor employee or Subcontractor employee that DCH deems to be unacceptable. DCH’s decision on this matter shall not be subject to Appeal. Notwithstanding the above provisions, the Parties acknowledge and agree that the Contractor may terminate any of its employees designated to perform work or services under this Contract, as permitted by applicable law. In the event of Contractor termination of any key staff identified in 14.1.4, the Contractor shall provide DCH with immediate notice of the termination, the reason(s) for the termination, and an action plan for replacing the discharged employee.
Staffing Changes. Contractor shall provide, to PDSC and the affected court, notice of the names of attorneys who are hired or leave Contractor's employ and any other substantial staffing changes. Staffing Changes. The Provider may make substitution of Key Personnel only upon prior written approval of the Department. In the event the Provider desires to substitute any Key Personnel approved to work on this contract, either permanently or temporarily, the Provider shall submit a resume including references, for each substitution of staff proposed. The Department shall determine, based on the information submitted, whether the proposed staff meets provider’s obligations with regard to the requirements for the position. For any Key Personnel terminations or departures which occur during the term of this contract, the Provider shall provide written notification of the vacancy at least ten (10) business days prior to the date the position becomes vacant. The Department may request the Provider to submit a resume of proposed equivalent skilled replacement Provider staff. If the Department determines that the proposed replacement staff meets the professional specifications required for services under this contract, an employment begin date will be determined by mutual agreement between the Department and the Provider. Requirement to Replace Detrimental Provider Staff The Provider shall replace any Provider employee whose continued presence would be detrimental to the achievement of the agreed upon requirements of this contract, as determined solely by the Department, with a Provider employee of equal or superior qualifications. If the Department exercises this right, the Provider must remove the Provider staff from the work site associated with this contract within three (3) business days after notice by the Department.
Staffing Changes. The following is intended to provide for increased RN input into staffing decisions affecting registered nurses. At least three weeks prior to any final decision to make a change in the staffing matrix, or at any time at the request of the Association, a meeting shall be called by management or the Association for the following reasons: • A change in the staffing matrix • Review of current staffing guidelines • A Review of Staffing Concern Analysis forms The meeting notice will include information on the unit and/or shift impacted and a brief summary of the issue. The meeting will be scheduled within 10 calendar days from the date it is requested. The meeting will be attended by the Senior Nurse Leader (or designee), the affected Nurse Manager/Department Director (or designee), the Local Unit Chair and 3 nurses selected by the Association. Attendance at meetings will be on unpaid time unless the nurses are otherwise scheduled. One unit officer shall be paid at the base rate of pay (without premiums or differentials) for attendance at this meeting.
1. At this meeting the party calling the meeting shall provide information relevant to the concern. This may include pertinent background data, information relevant to the cost center, budget parameters, timelines, care delivery goals and other relevant information.
2. After collaborative review between staff and Administration in Unit staff meetings and the meeting referenced above, any mutually agreed upon alternatives/options which meet the unit budgetary parameters, timelines and/or care delivery goals will be implemented in lieu of the original intended staffing changes. A local Unit officer may choose to be present at any such meetings. The hospital may implement its original changes to the staffing guidelines if there are no mutually agreed upon alternative options, and provide rationale for these changes. The Hospital will continue to be open to discuss any new ideas related to the changes at future Conference Committee meetings. Before any change is implemented, notice will be provided to the staff.
3. Changes will be evaluated on the affected unit by Administration and staff using the same criteria identified above. The Conference Committee will review the evaluation and examine the findings/concerns at a regularly scheduled meeting no later than four (4) months following implementation of the changes.

Staffing Changes. The Parties acknowledge that it is in the best interests of the Agreement to maintain the same individuals in their roles for the duration of the Agreement, to the extent possible. NYS retains the right in its reasonable discretion to request replacement of any Contractor key employees assigned from this Agreement at any time. If the Contractor wishes to replace any key employees assigned from the Agreement prior to commencement of his or her assignment or during his or her assignment period (Contract Period), the Contractor shall first, before proceeding with such replacement, notify the State and present the State with information about the replacement, Contractor key employees.
