Special Notices. Each Party shall notify the other by telephone as soon as practicable (with written confirmation within three business days) upon its receipt of any technical complaint or notice of severe adverse reaction (hypoglycemia shall not be considered an SAE); provided, however, that notification of serious, new or unexpected experiences reported with increased frequency shall be made immediately (but in any event not more than thirty-six (36) hours after the notifying Party learns of such experiences). Notwithstanding the foregoing, service of process to commence a summary proceeding pursuant to Article 7 of the Real Property Actions and Proceeding Law (“RPAPL”) relating to an occupancy by the City of New York or its agencies or officers of the Demised Premises which at its commencement was authorized under this Lease shall be served in manner required by CPLR Section 311.
Special Notices. (a) CTI shall notify ACX, in the manner specified in subparagraph 5.03(b), concerning all Third Party Claims where ACX is or could be named a party thereto or where, based on information available to CTI at that time, there is a reasonable likelihood that, based on the outcome of such Third Party Claim, the reputation of ACX or any Affiliate of ACX could be adversely affected, or ACX's or any Affiliate's ability to conduct its business or to take certain actions with respect thereto could be impaired as a result of any injunctive relief sought, or ACX could be liable for the payment of monetary damages. ACX or its Affiliate shall have the right to participate in the development and execution of strategy for the response to, preparation for and handling of such Third Party Claim in addition to its rights under Section 5.03.
