DISCRIMINATION OR HARASSMENT. (The following provisionswill appear in all collective agreements replacing any provisions related to No Discriminationor Harassmentthat existed in the Hospital'sexpiring collective agreement:) The Hospital and the Union agree that there will be no discrimination, interference, intimidation, restriction or coercion exercised or practiced by any of their representatives with respect to any employee because of his membership or non-membership in the Union or activity or lack of activity on behalf of the Union or by reason of exercising his rights under the Collective Agreement. It is agreed that there will be no discrimination by either party or by any of the employees covered by this Agreement on the basis of race, creed, colour, national origin, sex, maritalstatus, age, religious affiliation,sexual orientation or any other factor which is not pertinent to the employment relationship. Every employee who is covered by this agreement has a right to freedom from harassment in the workplace in accordance with the Ontario Human Rights Code.

Any Tenneco personnel who is found to have violated these provisions will be subject to severe disciplinary measures up to and including termination. DISCRIMINATION OR HARASSMENT. No person shall be required, as a condition of employment, to become or remain a member of any union or other organization, and no statements or representationsto the contrary shall be made. There shall be no discrimination by the Company or the Union or any employee against any employee because of membership or non-membership in any lawful union, or because of his race, creed, colour, sex, nationality, ancestry, place of origin, political opinions, family status, ethnic origin, citizenship, sexual orientation, age, disability, record of offenses, or marital status. Stewards, Union safety representatives or employees filling any other Union position shall not be denied promotions, training opportunities, transfers or overtime because of their Union activity. The Company and the Union recognize that harassment based on a prohibited ground of discrimination under the Ontario Human Rights Code is prohibited by law and any such conduct will not be tolerated. Harassment is defined as engaging in a course of vexatious comment or conduct, related to a prohibited ground of discrimination under the Code that is known or ought reasonably to be known to be unwelcome. Article Management The Union agrees that the Company has the exclusive right and power to manage the Offices, Plants and Mines, direct the working forces and to hire, promote, transfer, demote, layoff and to suspend, demote, discharge or otherwise discipline employees for just cause; provided, however, that any exercise of the foregoing rights and powers in conflict with any of the provisions in this Agreement shall be subject to the provisions of the grievance procedure.
