Call-In Pay/Court Pay. When a member is called back for work by the Chief or designee on hours not abutting such member's regular shift hours, the member shall be paid or credited with a minimum of three (3) hours at the appropriate rate of pay. This provision shall apply to members called in to off duty court appearances. A member called back on his or her second day off shall be compensated at two (2) times his or her regular rate of pay for a minimum of three (3) hours, except when the call back is for training purposes where the member will compensated at one and one-half (1 ½) times his or her regular rate of pay.

Call-In Pay/Court Pay. A member directed to work any portion of a tour of duty or appearance in court that is not contiguous with his/her regularly scheduled rate tour of duty shall be compensated for a minimum of two (2) hours of pay at the appropriate rate whether straight time or overtime. Any member on scheduled vacation or other approved leave including scheduled days off who is directed to work or required to appear in court on such day shall receive a minimum of four (4) hours of pay at the appropriate rate whether straight or overtime.

If a member is given at least fifteen (15) days' advance notice of a call-in for physical fitness testing, health assessment screening, intoxilizer qualification or L.E.A.D.S. testing, then compensation for the time will be on an hour-for-hour basis. A member who is required to be on- call for a court appearance shall receive pay at the applicable rate until the earlier of the following times: (a) the City notifies the member that he/she is no longer required to remain on-call (notification by the City is complete when the City completes a telephone call or delivers a message to the member’s residence); or (b) three hours after being on-call, at which time the member is released from on-call status unless notified to the contrary. It is the member’s responsibility to make sure that he/she can receive a telephone message relative to on-call status (a telephone answering machine is not acceptable for this purpose).

This provision shall apply portal to portal to employees called in while off-duty for court appearances. Employees, otherwise off duty, who are required by the Court to be and remain available for work-related court sessions, shall be compensated at the overtime rate for such time not to exceed two (2) hours in duration. In order to be compensated for more than two (2) hours at the appropriate overtime rate for said purpose, the employee must provide appropriate justification from the Court that the employee was required to remain available for said time in excess of two (2) hours.
