You agree not to download, access for the purpose of copying or otherwise seek to modify, adapt or translate the Service and further agree not to attempt to reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Service. You may not rent, lease, distribute or lend the Service to third parties. The Service is licensed as a single unit, and its component programs may not be separated for some other use. Further, you agree not to place the Service onto or into a shared environment accessible via a public network such as the Internet or otherwise accessible by others outside the single device of the single location referred to in Section 1 above.

You may not modify, translate or create derivative works of the Software, except as expressly permitted by an OSS License. You may not remove or obscure any proprietary notices, identification, label or trademarks on or in the Software or the supporting documentation. You may permanently transfer all of your rights under this agreement solely in connection with transfer of the Product; provided that you retain no copies, you transfer all of the Software (including all component parts, the media and printed materials and any Releases), and this license agreement, and, if applicable, the Certificate of Authenticity), and the recipient agrees to the terms of this license agreement. If the Software is a Release, any transfer must include all prior versions of the Software. However, if the Software is marked "Not for Resale" or "NFR", you may not resell it or otherwise transfer it for value. User may not transfer or sub-license the Licensed software to any third party, in whole or in part, in any form whether modified or unmodified. This Agreement and the licenses granted by it may not be assigned, sub-licensed, or otherwise transferred by User without the prior written consent of DirWiz.
Other Rights and Limitations. Activation. The LICENSED SOFTWARE contains technological measures that are designed to prevent its unlicensed or illegal use. The LICENSED SOFTWARE may contain enforcement technology that limits LICENSEE’s ability to install and uninstall the LICENSED SOFTWARE on a machine to no more than a finite number of times, and for a finite number of machines. If any such applicable activation procedure(s) are not followed, then the LICENSED SOFTWARE may only operate for a finite period of time. If LICENSEE has any problem with the activation process, LICENSEE should contact PATAGAMES customer support. The absence of any activation measures shall not be taken to mean that PATAGAMES consent to any use of the LICENSED SOFTWARE beyond the uses permitted in this Agreement.

You may not, and may not permit or aid others to, translate, reverse engineer, decompile, disassemble, update, modify, reproduce, duplicate, copy, distribute, place the Software onto a server so that it is accessible by third parties via a public network or otherwise disseminate all or any part of the Software, or extract source code from the object code of the Software. You may not publish or make available to the public, without Licensor's prior written approval, your impressions, evaluations, notes or recommendations from the use of the Software. The Software is licensed as a single product; you may not separate its component parts for use on more than one computer or for any other purpose. You may not assign, sublicense, transfer, pledge, lease, rent, or share your rights under this Agreement. Any data processed, shared, transferred or otherwise used by you, including any of your users, is your sole responsibility. You must comply with applicable data protection laws and regulations. You must verify that no unauthorized users have access to your data. YOU SOLELY, ARE RESPONSIBLE TO BACK UP YOUR DATA. Under no circumstances will Licensor be liable for any inaccuracy, loss of or damages to your data used by you including any of your users by means of the Software.

Subscription Services are for use only with Customer’s normal business e-mail traffic. You shall not use Subscription Services, unless specifically permitted by us in writing, to encrypt application-generated (bulk) emails. You may use your Subscription Services for your affiliated companies’ personnel. You may assign this Agreement in connection with any acquisition of your business or assets so long as the transferee is bound by the terms of this Agreement and you provide prior notice in writing to Zix. Zix may assign its rights and obligations under this Agreement, in whole or in part, to any party at any time. Zix may terminate this Agreement upon written notice to you if you materially breach this Agreement, including non-payment of our Fees, or any other agreement between you and Zix. Upon termination, you agree to (i) discontinue use of the Subscription Services; (ii) remove Subscription Materials from all computers and servers; and (iii) destroy or return to Zix all archived copies of the Subscription Materials. Customer acknowledges that the Subscription Services are subject to U.S. export control laws and other applicable export and import laws and Customer shall not use or disseminate the Services or any aspect thereof in violation of such laws (more information is available at the Legal Webpage).
