SOFTWARE shall definition

SOFTWARE shall mean Licensed Software and software (firmware) incorporated in hardware Products.
SOFTWARE shall mean the software product(s) identified as `Arias Technology Corporation Video Browser' and `Arias Technolxxx Xorporation In Car Video Application', as modxxxxx from time to time by Supplier.
SOFTWARE shall mean the software specified in Exhibit I.

Examples of SOFTWARE shall in a sentence

  • All rights to the source code of the SOFTWARE shall belong exclusively to the LICENSOR.

  • Siemens and where applicable their licensors in the LICENSED SOFTWARE shall be free to use any feedback and/or technical data including audit data received from You resulting from your access to and use of the LICENSED SOFTWARE for any purpose for business purposes, including (without limitation) development, manufacture, marketing, product ordering, and maintenance or support of products and services.

  • Any component of the LICENSED SOFTWARE shall be used exclusively for the “MSIBTM".

  • Upon termination of the work to be done, the appointed entity of SOPRA HR SOFTWARE shall undertake to delete all the data transferred or, if any legal data retention requirement is applicable, to keep it recorded, provided that appropriate technical and organizational measures are taken to protect Personal Data against any unlawful form of processing.

  • The appointed entity of SOPRA HR SOFTWARE shall undertake in writing to provide those sufficient guarantees.

  • With regard to the scope of our BCRs, appropriate entities and employees of SOPRA HR SOFTWARE shall comply with the following provisions, as well as with applicable local laws.

  • As a threshold issue, this Court addresses the law of the case doctrine.

  • Save any contrary specification in any CONTRACT, all software to be delivered under such CONTRACT and which are not STANDARD SOFTWARE shall be construed as being CONTRACTOR’s SOFTWARE and all provisions specified in Clause 31.5.3 shall apply accordingly.

  • Each entity of SOPRA HR SOFTWARE shall take every necessary step to make sure that Local Data Processors comply with the provisions of the BCRs. To this end, a "BCR compliance check list" shall be used at local level to make compliance checks.

  • An exhaustive and updated copy of the source code of each SPECIFIC SOFTWARE shall be communicated to the BUYER at any time, without any restriction of any kind, upon BUYER’S first demand.

Related to SOFTWARE shall

  • Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.

  • Software License means a license for the Software granted under this XXXX to the Licensee;

  • WorkSafeBC means the Workers Compensation Board, a provincial Crown corporation created pursuant to the Workers Compensation Act (British Columbia);

  • Software Updates means the Software releases, service packs, build updates or emergency fixes released from time to time in accordance with the Vocera’s update policy for such Software.

  • Public Software means any Software that contains, or is derived in any manner (in whole or in part) from, any software that is distributed as free software, open source software (e.g., Linux) or similar licensing or distribution models, including, without limitation, software licensed or distributed under any of the following licenses or distribution models, or licenses or distribution models similar to any of the following: (A) GNU’s General Public License (GPL) or Lesser/Library GPL (LGPL), (B) the Artistic License (e.g., PERL), (C) the Mozilla Public License, (D) the Netscape Public License, (E) the Sun Community Source License (SCSL), (F) the Sun Industry Standards License (SISL), (G) the BSD License, and (H) the Apache License.

  • Customized Software or “Customization” means any Application Software code modified or amended on behalf of the Customer. Setting of parameters, parameterization or configuration is not a Customization.

  • Standard Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Standard Software.

  • Hosted Software means Samsara’s web-based software platform, including the interface accessed online at cloud.samsara.com.

  • Software License Agreement means the particular Software License Agreement to which these Terms and Conditions are attached and incorporated into by reference.

  • Client Software means software that allows a Device to access or utilize the services or functionality provided by the Server Software.

  • CTS Enabled Interface means an interface between the PJM Control Area and an adjacent Control Area at which the Office of the Interconnection has authorized the use of Coordinated Transaction Scheduling (“CTS”). The CTS Enabled Interfaces between the PJM Control Area and the New York Independent System Operator, Inc.   • Maintenance Services means SAP’s then-current maintenance and/or support services offered under and described in detail in the applicable SAP PartnerEdge Model.

  • Computer Hardware and Software means all of each Loan Party’s and each of its Subsidiary’s rights (including rights as licensee and lessee) with respect to (a) computer and other electronic data processing hardware, including all integrated computer systems, central processing units, memory units, display terminals, printers, computer elements, card readers, tape drives, hard and soft disk drives, cables, electrical supply hardware, generators, power equalizers, accessories, peripheral devices and other related computer hardware; (b) all software and all software programs designed for use on the computers and electronic data processing hardware described in clause (a) above, including all operating system software, utilities and application programs in whatsoever form (source code and object code in magnetic tape, disk or hard copy format or any other listings whatsoever); (c) any firmware associated with any of the foregoing; and (d) any documentation for hardware, software and firmware described in clauses (a), (b) and (c) above, including flow charts, logic diagrams, manuals, specifications, training materials, charts and pseudo codes.

  • Database Management System (DBMS) A system of manual procedures and computer programs used to create, store and update the data required to provide Selective Routing and/or Automatic Location Identification for 911 systems. Day: A calendar day unless otherwise specified. Dedicated Transport: UNE transmission path between one of CenturyLink’s Wire Centers or switches and another of CenturyLink’s Wire Centers or switches within the same LATA and State that are dedicated to a particular customer or carrier.
