Other Hazardous Substances. Architect acknowledges that other substances that are regulated by laws, codes or regulations because of hazards they pose to human health and the environment may exist in building materials, soils, or equipment used on the Project site. Architect shall not be primarily responsible to identify hazardous substances existing on the Project site or used by others for whose conduct Architect is not responsible. However, in the event Architect recognizes any improper handling or storage of hazardous substances on the Project site or observes circumstances which Architect actually knows may result in the release or discharge of hazardous substances, Architect shall immediately notify Owner and Contractor thereof.

Other Hazardous Substances. Except as to those Hazardous Substances listed in Exhibit D in the limited quantities set forth in Exhibit D, and such Hazardous Substances as are (i) intended for and used for normal building cleaning, maintenance and repair, and (ii) ordinary and customary Hazardous Substances and quantities for the nature of business conducted by Tenant at the Commencement Date (with the parties' acknowledgment that the specific kinds of Hazardous Substances Tenant uses in the conduct of its business may change from time to time), Tenant shall not use, generate, produce, store, bring upon, treat or dispose of any Hazardous Substance on the Premises without the prior written consent of the Landlord. With regard to other Hazardous Substances, whether in type or quantity limits, that Tenant proposes to use on the Premises, Landlord shall, taking into account such factors as relevant, promptly grant or withhold consent to the proposed use of such Hazardous Substances in the quantities proposed. In addition, Landlord may condition its consent to the use or presence of any Hazardous Substance by Tenant upon Tenant's giving Landlord such additional assurances as Landlord, in its sole discretion, deems necessary to protect itself, the public, the Premises, and the environment against damage, contamination or injury and/or liability therefrom or therefor, including, but not limited to, the installation (and removal on or before Lease expiration or earlier termination) of reasonably necessary protective modifications to the Premises and/or the deposit of a reasonable additional Security Deposit (as defined in Paragraph 38 of the Lease).

In addition, Sublessor may condition its consent to the use or presence of any Hazardous Substance by Sublessee upon Sublessee's giving Sublessor such additional assurances as Sublessor reasonably deems necessary to protect itself, the public, the Premises, and the environment against damage, contamination or injury and/or liability therefrom or therefor, including, but not limited to, the installation (and removal on or before Sublease expiration or earlier termination) of reasonably necessary protective modifications to the Premises and/or the deposit of a reasonable additional Security Deposit.

In the event Lessor elects to give such notice of Lessor's intention to terminate this Lease, Lessee shall have the right within ten (10) days after the receipt of such notice to give written notice to Lessor of Lessee's commitment to pay for the excess costs of (a) investigation and remediation of such Hazardous Substance Condition to the extent required by Applicable Requirements, over (b) an amount equal to twelve (12) times the then monthly Base Rent or $100,000, whichever is greater. Lessee shall provide Lessor with the funds required of Lessee or satisfactory assurance thereof within thirty (30) days following said commitment by Lessee. In such event this Lease shall continue in full force and effect, and Lessor shall proceed to make such investigation and remediation as soon as reasonably possible after the required funds are available. If Lessee does not give such notice and provide the required funds or assurance thereof within the time period specified above, this Lease shall terminate as of the date specified in Lessor's notice of termination.
