Intended Use. In the event that the subscriber needs to provide any of the shares purchased hereunder to one of its limited partners in order to buy back all partnership equity from that limited partner, then the issuer shall transfer to that limited partner a quantity of issued shares according to an amount indicated by the subscriber. In such case, these transferred shares will continue to be restricted. Although restricted, the shares will be eligible for dividends. These dividends will be held by the issuer until the note is satisfied either by exchanging the value of the note for real estate owned by the subscriber or by sale, hypothecation, or encumbrance of the note by issuer. Under such conditions, these transferred shares shall become fully paid and non-assessable.
Intended Use. Tenant shall use the Leased Property as a senior independent and/or assisted living facility and for such other uses as may be related, incidental or necessary thereto (the "Intended Use") and for no other purpose. Tenant's use of the Leased Property shall, subject to the right of diligent contest as provided in Paragraph 26, comply with all zoning classifications of any lawful Governmental Agencies or other public or private regulatory authority (including insurance underwriters or rating bureaus) having jurisdiction over the Leased Property and shall otherwise comply with applicable Legal Requirements. Tenant shall not perform any act or follow any practice relating to the Leased Property which shall constitute a nuisance. Subject to the terms and provisions of this Lease, Tenant shall have the right to control the business being conducted at the Leased Property.
Intended Use. Tenant shall use the Leased Properties as a senior housing facility, including, without limitation, as a senior housing and/or independent living and/or an assisted living facility and for such other uses as may be related, incidental or necessary thereto (the "Intended Use") and for no other purpose; provided, that in no event shall any of the Leased Properties be used as a skilled nursing facility. Tenant shall not perform any act or follow any practice relating to any of the Leased Properties which shall constitute a nuisance. Subject to the terms and provisions of this Lease, Tenant shall have the right to control the business being conducted at each of the Leased Properties.
Intended Use. The Device is a sterile, single use electrosurgical device intended to be used in conjunction with an electrosurgical generator for the delivery of radiofrequency current and sterile saline for hemostatic sealing and coagulation of the soft tissue in accordance with instructions and user procedures provided by BSC. The device is not intended for any other unspecified uses.
Intended Use. INVESCO agrees and understands that the Property Appraisal reports will be subject to CAPRIGHT’s General Assumptions and Limiting Conditions attached as Exhibit B hereto, which will be incorporated into the report. All users of the Property Appraisal reports are specifically cautioned to understand the Assumptions and Limiting Conditions as well as any extraordinary assumptions and hypothetical conditions which may be employed by CAPRIGHT and incorporated into the report. Moreover, all users should consider the report as only one factor together with its independent investment considerations and underwriting criteria in its overall investment decision.
Intended Use. On or before the Contingency Date, Developer shall have determined the acceptability of the Property for its intended use and incidental uses thereto (collectively, the “Proposed Use”). All costs and expenses related to applying for and obtaining any governmental permits and approvals for the Property for the Proposed Use shall be the responsibility of the Developer.
