Materials and Appliances. Unless otherwise stipulated, the Contractor shall provide and pay for all materials, water, heating, lighting, fuel, power, transportation, machinery, appliances, telephone, sanitary facilities, temporary facilities, and other facilities and incidentals necessary for the execution and completion of the Project. Contractor warrants to the City that, unless otherwise specified, all materials furnished under this Contract shall be new and that both workmanship and materials shall be of good quality, free of faults and defects, and in conformance with the Contract. Contractor shall, if required, furnish satisfactory evidence as to the kind and quality of materials. Material and/or equipment damaged by flooding or other causes during the construction period shall be subject to rejection by the City Representative. Reconditioning and/or repairing materials used for the Project is not acceptable unless first approved by the City Representative.

The CONTRACTOR, shall, if required, furnish satisfactory evidence as to the kind and quality of materials. In selecting and/or approving equipment for installation in the project LPID and LPID assume no responsibility for injury or claims resulting from failure of the equipment to comply with appli- cable national, state, and local safety codes or requirements, or the safety requirements of a recognized agency, or failure due to faulty design concepts, or defective workmanship and materials.

For the avoidance of doubt the Parties hereby agree that shall the Design Documentation explicitly stipulate Contractor’s right to choose between different types of Materials and Appliances, the selection will be made by the Contractor subject to Employer’s approval in keeping with Quality Management System procedures. The Materials i Appliances that are inconsistent with the terms and conditions of the Contract or of Design Documentation, and in particular those inconsistent with Standards or devoid of relevant attestations, certificates and admissions for use in the Republic of Poland, must be promptly removed from the Construction Site by the Contractor at its own expense and replaced with other such items, consistent with the conditions referred to above.   • Materials and Equipment ‌ Material means property that may be consumed or expended during performance, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for performance. Materials and Equipment shall be priced in accordance with the terms of the task order award, contract type, and applicable FAR and agency-specific regulatory supplements. Unless otherwise directed by task order terms and conditions, the Contractor may apply indirect costs to materials and equipment consistent with the Contractor’s usual accounting practices.

  • Materials and Supplies The cost of materials and supplies is allowable.
