Bidders Responsibility. Bidders will be held to have examined the drawings; to have visited the site; and to have informed themselves as to existing conditions and limitations. Bids shall cover the execution of the whole of the Work as described in the Specifications, as shown on the Drawings / Sketches and as described in any Addendums that may be issued.
Bidders Responsibility. Bidders shall assume all responsibility for conditions that may exist at the site of the proposed Work and adjacent premises, including approach and access to the sites, and shall assume all responsibility for delivering and handling of materials at the site, and for all difficulties involved in the completion of all Work ordered under this Contract in accordance with its requirements. Bidders may request, up to seven (7) days prior to the bid due date and time, a pre-inspection walk through of some of the Authority’s facilities in order to fully understand the precise specifications of the electrical equipment potential bidders may be required to work on under this contract. The Bidder must meet all of the requirements set forth herein, including the qualifications required in Sections 5 and 7 herein, including evidence of his past safety record.

The Town Board's decision will be based upon whether or not and to the extent the Homeowners Association contract with its present hauler is a valid and enforceable contract and shall include consideration of whether or not such contract has been entered into or renewed after the date of the resolution establishing and public announcement of mandatory residential services within the District, and/or whether any such contract can be legally terminated or may be enforceable as against or subject such Homeowners Association to a legally enforceable claim for damages, it however being the intent of the Town to mandate District provided service to all residential Units within one to three family homes in the District and to preempt, supersede and/or nullify any such contract that as a matter of law or otherwise is or can be so preempted, superseded or nullified.
Bidders Responsibility. Each bidder shall familiarize himself with all of the attached forms, Instruction, General Conditions, Specifications, et cetera, as he will be held responsible to fully comply therewith. Each bidder must visit the site of the work and acquaint himself with conditions affecting the work. Bidders shall properly register on the PennBid site. They shall familiarize themselves with the PennBid web site, navigating the PennBid web site, requesting information, the PennBid bidding methodology, completing the PennBid bid form, and the uploading of required bid forms and surety certificates. If needed, it is incumbent upon bidders to request assistance in familiarizing themselves. Bidders are encouraged to contact either PennBid or Pennoni Associates, if assistance is needed.

Bidders Responsibility. The Bidder assumes sole responsibility for the complete effort required in this RFP. No special consideration will be given after bids are opened because of a Bidder’s failure to be knowledgeable of all the requirements of this RFP. Failure to do so will be at the Bidder’s own risk and the Bidder cannot secure relief on the grounds of any mistake. • The selected Bidder will be required to enter into a written agreement with Gauteng Department of Education. This RFP or any part thereof may be incorporated into and made part of such an agreement. The Gauteng Department of Education shall not incur any obligation or liability towards the selected Bidder until a written contract has been signed by the duly authorized Gauteng Department of Education representative and the Bidder.

No pleas of ignorance relating to any data, conditions or requirements that exist or that may be encountered under this contract will be accepted as a result of failure or omission on the part of the FSMC to fulfill in every respect all the requirements, nor will the same be accepted as a basis for any claim whatsoever for extra charges for food services.
