The Company’s quoted prices do not reflect the cost of accommodating Customer’s purchases via credit card or any third-party procurement services, software or e-commerce providers and the Company may accordingly pass through the additional charges incurred as a result of Customer’s use of such purchasing methods. Prices shown do not include any local taxes or any present or future sales, use, excise, value-added or similar taxes. Where applicable, such taxes shall be billed as a separate item and paid by Customer. Orders are accepted with the understanding that such taxes will be added, as required by law. The Company charges local sales tax unless Customer has a valid sales tax exemption certificate on file with the Company.

AVAILABILITY AND PRICING. All Products offered by Lynxspring are subject to availability, and Lynxspring reserves the right to impose quantity limits on any order, to reject all or part of an order and to discontinue offering certain Products without prior notice. Prices for the Products are subject to change at any time, but changes will not affect any order for Products you have already placed. Lynxspring has one price increase for Niagara related products occurring in September of each calendar year and Prices our third-party products vary according to the respective provider. The current price list can be found on our Resources website (xxxxx://xxxxxxxxx.xxxxxxxxxx.xxx/) which you must have a valid login to access. Although Lynxspring does provide an email notification to our partners that our price list has been updated, the customer is responsible for using the current price list on our website at all times. In the event Lynxspring changes the pricing for any subscription services you have purchased in connection with a Product and/or Service, Lynxspring will provide you advance notice of this change in accordance with the notification provisions of Section 16 of these Terms and Conditions. After receiving this notice, you will be deemed to have accepted the change in pricing, unless you cancel your subscription or service by notifying xxxxxxxxxx@xxxxxxxxxx.xxx of your desire to cancel. Note that merely unpairing a Product from a subscription service will not trigger cancellation of the subscription service. In the event you cancel a subscription service, Lynxspring will provide a prorated refund for the period of time starting the day after cancellation of the subscription service through the remainder of your billing cycle except as otherwise provided in the Terms of Service applicable to such subscription service.

For electronic products incorporating the Journal’s contents (e.g., Web access or CD/DVD-ROMs), pricing will be established by similar means, but may be different from the pricing of paper copies.

  • General Availability The commitment to availability specified in the letter of appointment shall be subject to mutually acceptable revision. Such revision will occur once per year, or, if mutually agreed between the Employer and the employee, on a more frequent basis. The Employer will issue a revised letter of appointment to reflect approved changes to employee’s general availability.

If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.

Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.

  • EPP service availability Refers to the ability of the TLD EPP servers as a group, to respond to commands from the Registry accredited Registrars, who already have credentials to the servers. The response shall include appropriate data from the Registry System. An EPP command with “EPP command RTT” 5 times higher than the corresponding SLR will be considered as unanswered. If 51% or more of the EPP testing probes see the EPP service as unavailable during a given time, the EPP service will be considered unavailable.

  • DNS name server availability Refers to the ability of a public-­‐DNS registered “IP address” of a particular name server listed as authoritative for a domain name, to answer DNS queries from an Internet user. All the public DNS-­‐registered “IP address” of all name servers of the domain name being monitored shall be tested individually. If 51% or more of the DNS testing probes get undefined/unanswered results from “DNS tests” to a name server “IP address” during a given time, the name server “IP address” will be considered unavailable.

  • Availability of Rule 144 The Purchaser shall not be obligated to register shares of DocuNet Common Stock held by the Seller at any time when the resale provisions of Rule 144(k) (or any similar or successor Seller provision) promulgated under the Securities Act are available to the Seller.
