Annual Sick Leave Payout. A. An employee hired prior to December 21, 1981, who does not take the full amount of sick leave granted in any one calendar year may accumulate the amount from year to year. When the employee has accumulated a sick leave balance of 1,104 hours, such employee shall be paid for up to 48 hours of his accumulated sick leave in that year and each year thereafter and continues to maintain the minimum sick leave balance of 1,104 hours. To be eligible for the annual sick leave payout, the employee must be employed by the City for the entire calendar year in which the eligibility occurs. In the year in which an employee is eligible for and will receive payment for sick leave payout at retirement as provided in Article 29, Xxxx Leave Payout at Separation, the employee will not be eligible for the annual sick leave payout as provided in this Article. This payment of accumulated sick leave will be paid at the employee’s regular base hourly rate as of December 31 of the same calendar year in which the payout was earned. This payout will be made to the employee by no later than the third paycheck paid in the year following the year the payout was earned.

Annual Sick Leave Payout for Employees Hired on or Before June 30, 2013: Employees who regularly work one-half (1/2) time or more who have attained the two hundred (200) day maximum sick leave accumulation, shall be entitled to receive payment for one-third (1/3) of the first twelve (12) days of sick leave days, or if earning sick leave at the rate of two (2) working days each month of service, one-third (1/3) of the first twenty-four (24) days of sick leave days, for which they become eligible, do not use and would otherwise forfeit because of the two hundred (200) day maximum limitation. Determination of eligibility for such payment shall be made on an annual calendar year basis, and payment for such sick leave for any calendar year shall be made not later than the first full pay period in January. Such payment shall be at the employee's salary rate in effect on the preceding December 31, and shall be made only in units of whole days, and will not be made for any fraction of a day.

The amount of time for which an employee is paid shall be deducted from the employee’s total accumulation. For employees with a District start date on or after November 2, 1994, there will be no cash payment for any unused accumulated sick leave on an annual basis. SICK LEAVE PAYOUT AT SEPARATION When an employee with a District start date prior to November 2, 1994 separates from the District for reasons other than discharge, such employee shall receive a payment for fifty percent (50%) of his or her accumulated sick leave balance at the time of separation to a maximum of 60 days’ pay. The payout shall be calculated at the rate of pay the employee was receiving at the time of separation. When an employee with a District start date of November 2, 1994 through December 31, 2011 separates from the District for reasons other than discharge, such employee shall receive a payment for fifty percent (50%) of his or her accumulated sick leave balance for either the amount of sick leave accumulated through December 31, 2011, or the amount of sick leave the employee has at the time of separation, whichever is lesser, but in no instance shall the amount of accumulated sick leave eligible for payout be greater than 120 days. The payout amount shall be calculated at the rate of pay the employee was receiving at the time of separation to a maximum of 60 days' pay. For employees with a District start date of January 1, 2012 or later, upon separation for reasons other than discharge, the employee will receive a payment for fifty percent (50%) of his or her accumulated sick leave balance at the time of separation to a maximum of 15 days’ pay. The payout amount shall be calculated at the rate of pay the employee was receiving at the time of separation.
