Seniority and Benefits. Seniority and benefits do not accrue while on layoff status. Upon recall within 12 months of layoff, employees will have previously accrued seniority and benefits restored and will again commence accruing seniority and benefits.

When the layoff is a reduction in the number of hours worked in a workday, workweek or pay period, the nurse shall continue to receive fringe benefits. Seniority and Benefits. Unless otherwise provided for by law, employees on an approved leave of absence without pay shall neither gain nor lose seniority and will not earn any benefits during leave extending beyond thirty (30) calendar days. The Employer need not make a health insurance contribution except for the month in which the leave begins.

Seniority accumulation and benefit entitlement for employees on long-term disability shall be con- sistent with the following provisions: Any employee granted unpaid leave of absence totalling up to twenty (20) working days in any year shall continue to accu- mulate seniority and all benefits and shall return to her/his former job and increment step. If an unpaid leave of absence or an accumulation of unpaid leaves of absence exceeds twenty (20) working days in any year, the employee shall not accumulate benefits from the twenty-first (21st) day of the unpaid leave to the last day of the unpaid leave but shall accumulate benefits and receive credit for previously earned benefits upon expiration of the unpaid leave. Upon return to work following recovery, an employee who was on claim for less than twenty-four (24) months shall continue in her/his former job; an employee who was on claim for more than twenty-four (24) months shall return to an equivalent position, exercising her/his seniority rights if necessary, pur- suant to Article 6.04 of the Master Agreement.
