Unpaid Leave - Affecting Seniority and Benefits. Any employee granted unpaid leave of absence totalling up to twenty (20) working days in any year shall continue to accumulate seniority and all benefits and shall return to her/his former job and increment step. If an unpaid leave of absence or an accumulation of unpaid leaves of absence exceeds twenty (20) working days in any year, the employee shall not accumulate benefits from the twenty-first (21st) day of the unpaid leave to the last day of the unpaid leave but shall accumulate benefits and receive credit for previously earned benefits upon expiration of the unpaid leave.

If an unpaid leave of absence or an accumulation of unpaid leaves of absences carry into the next month, the employee shall have the option of continuing their benefits into that next month provided the employees makes such request and provides the Employer with post-dated cheque(s) for their share of the benefit cost prior to the commencement of the leave. Employees on unpaid leave for WCB, medical, compassionate care, family responsibility, jury duty, education leave, maternity, parental and adoption reasons shall continue to accumulate seniority.

Employees choosing to continue benefits shall, prior to the commencement of their leave, provide the employer with post- dated cheques for the duration of their absence. Employees choosing to not continue benefits shall have those benefits reinstated upon their return to work from unpaid leaves of absence.

Payment of benefit premiums shall be prorated for partial months. Employees on WCB, and employees on ICBC reimbursed leaves and other leave that would be covered by the Employment Standards Act, seniority shall be considered continuous. Employees on ICBC reimbursed leaves and any other leave that would be covered by the Employment Standards Act, vacation shall be considered continuous.

If the leave of absence does not exceed six (6) months, the employee may maintain coverage for health care plans provided in this agreement by paying the employee’s and the Employer’s share of the premiums for such coverage in advance on a month to month basis. This article does not apply to leaves of absence under Article 36.06.
