UNINTERRUPTED PATIENT CARE. 18.1 It is recognized that the Hospital is engaged in a public service requiring continuous operation and it is agreed that recognition of such obligation of continuous service is imposed upon both the nurse and the Association. During the term of this Agreement, neither the Association nor its members, agents, representatives, employees or persons acting in concert with them shall incite, encourage or participate in any strike, sympathy strike, picketing, walkout, slowdown, sick out or other work stoppage of any nature whatsoever. In the event of any such activity, or a threat thereof, the Association and its officers will do everything within their power to end or avert same. Any nurse participating in any such activity will be subject to immediate dismissal.

The Employer agrees that during this same time period, there shall be no lockouts.
UNINTERRUPTED PATIENT CARE. This clause is included in recognition of the mutual responsibility of the Union and the Employer for continuity of patient care. During the term of this Agreement, the Union and its members will not cause, sanction, condone, take part in, or in any way directly or indirectly aid in any strike, sympathy strike, walkout, picketing, boycott, slowdown, stoppage of work or any other interference whatever with the efficient operation and conduct of the Employer’s business, or take any action whatever to prevent access of employees to the Employer’s place of business. Both parties to the Agreement advocate at all times that any complaint, dispute or grievance be resolved through the procedures provided in Article 16 of this Agreement. In the event of any strike, sympathy strike, walkout, slowdown, work stoppage, hand billing or picketing by a Union member or threat thereof, the Union and its officers will make a good faith effort to end or avert the same.

During the term of this Agreement, neither the Union nor its members, agents, representatives, employees, or persons acting in concert with them shall incite, encourage, or participate in any strike, sympathy strike, picketing, walkout, slowdown, or other work stoppage of any nature whatsoever. In the event of any strike, sympathy strike, picketing, walkout, slowdown or work stoppage, or a threat thereof, the Union and its officers will do everything within their power to end or avert same. Any nurse participating in any strike, sympathy strike, picketing, walkout, slowdown, or work stoppage will be subject to immediate dismissal.

The Employer agrees that during this same period there shall be no lockouts, nor shall any employees be required to perform other than usual duties.

It is recognized that the Employer is engaged in a public service requiring continuous operation, and it is agreed that recognition of such obligation of continuous service is imposed upon both the Employer and the Union. Neither the Union nor its members, agents, representatives, employees or persons acting in concert with them shall incite, encourage, participate or in any way directly or indirectly aid others in any strike, sympathy strike, walkout, slowdown or other work stoppage of any nature whatsoever nor shall they engage in any picketing or other interference whatever with the efficient operation and conduct of the Employer’s business. In the event of any strike, sympathy strike walkout, slowdown or work stoppage or picketing, or a threat thereof, the Union and its officers will do everything within their power to end or avert same. The Employer shall not lock out its employees.

It is recognized that KVH is engaged in a public service requiring continuous operation and it is agreed that recognition of such obligation of continuous service is imposed upon both the employee and the Union. During the term of this Agreement, neither the Union nor its members, agents, representatives, employees or persons acting in concert with them shall incite, encourage or participate in any strike, picketing, walkout, slowdown or other work stoppage of any nature whatsoever. In the event of any strike, picketing, walkout, slowdown or work stoppage, or a threat thereof, the Union and its officers will do everything within their power to end or avert same. Any employee participating in any strike, picketing, walkout, slowdown or work stoppage will be subject to immediate dismissal. KVH agrees that during this same time period, there shall be no lockouts.
UNINTERRUPTED PATIENT CARE. The Employer and the Association realizing that a Hospital is different in its operation from industries because of type of service rendered to the community, and for humanitarian reasons agree that there shall be no lock-outs on the part of the Employer nor suspension of work on the part of the employees, it being one of the purposes of this Agreement to guarantee that there shall be no strikes, sympathetic picketing, work stoppages, or work slowdowns, and that all disputes will be settled as hereinafter provided. Nurses violating this Article shall be subject to immediate discharge.
UNINTERRUPTED PATIENT CARE. 19.1 The parties to this Agreement realize that this Hospital and other health care institutions provide special essential services to the community. For this and other humanitarian reasons, it is the intent of the parties to settle disputes by the grievance procedure provided for herein. It is, therefore, agreed that during the term of this Agreement, (a) the Employer shall not lock out its nurses, and (b) neither the nurses nor their agents nor other representatives shall, directly or indirectly, authorize, assist or encourage participation in any way in any strike, including any sympathy strike, picketing, walk-out, slow-down, boycott, or any other interference with the operations of the Employer, nor shall any nurse refuse to cross any other labor organization’s picket line.
