WORK HEALTH & SAFETY. 19.1 The Developer acknowledges that it is the Principal Contractor under WHS Law for the Works unless and until such time that the Developer engages a person to construct the Works, or engages another person conducting a business, or undertaking, to be the Principal Contractor for the Works, and authorises the person to have management or control of the workplace relating to the Works and to discharge the duties of a Principal Contractor under WHS Law.

WORK HEALTH & SAFETY. 36.1 The Supplier must comply with the Work Health and Safety Xxx 0000 (SA) at all times, regardless of whether the Government Party issues direction in that regard or not.
WORK HEALTH & SAFETY. The employer and employees recognise the importance of an effective work health and safety program in providing a safe work environment for all employees. It is further recognised that improved health and safety will ultimately increase productivity throughout Council by reducing the number of incidents/accidents and, therefore, lost time. The employer and the Union shall give full cooperation to the achievement of high standards of work health and safety. In so doing the employer and employees will strive to continually improve occupational health and safety performance in accordance with the WorkCover Exempt Employer Performance Standards and provide the highest level of rehabilitation processes for employees who sustain a work related injury or illness. The parties recognise safety education and safety programs shall be fundamental in achieving this objective. On all projects the employer and employees shall comply with all relevant health and safety guidelines and Safe Operating Procedures so as to provide and maintain a safe working environment.
WORK HEALTH & SAFETY. The Employer and Employees agree that a safe and secure workplace is important and must comply with Work Health & Safety laws. Employees will take all practicable steps to ensure their own safety while at work, and to ensure that no action or inaction by the Employee while at work causes harm to any other person. Employees will ensure safety procedures are followed at all times. Employees must ensure they know the Employer’s health and safety rules and procedures. Employees will not misuse any equipment that is provided to ensure work health and safety. Disciplinary action up to and including dismissal, may be taken against Employees who do not comply with the Employer’s rules and procedures regarding work health and safety. Employees will report to management as soon as possible any accidents, incidents or hazards arising during the course of employment. If Employees have any concerns in relation to their safety or the safety of others, the Employee is required to report these concerns to the safety officer or appropriate manager who will take all practicable steps to provide and maintain a safe work environment. Employees who knowingly falsely record or supply false information at any time during their employment or recruitment process will be immediately terminated and action taken to recover costs. In this event the Employer and Employee each agree to bear their own legal costs. Employees whose physical or mental health status changes and it may impact on their work during their period of employment are required to report the changes to their supervisor who, in consultation with the Employee will decide if the Employee is suitability to work or may require some assistance. At all times the privacy of the employee will be preserved.
