All Projects. Services submitted by A-E shall be complete and shall be carefully checked prior to submission. A-E understands that County's checking is discretionary, and A-E shall not assume that County will discover errors and/or omissions. If County discovers any errors or omissions prior to approving A-E's Projects/Services, the Projects/Services will be returned to A-E for correction. Should County or others discover errors or omissions in the work submitted by A-E after County's approval thereof, County's approval of A-E's Projects/Services shall not be used as a defense by A-E.

All Projects. The Consultant agrees to and shall provide energy efficient design and specify the maximum energy efficient equipment on all projects regardless of the project size or scope. The Consultant shall, through coordination and approval by the State, incorporate sustainable design options into the project.

The Project Yield of the remaining Projects after the release shall be (i) equal to or greater than 17.33% and (ii) equal to or greater than the Project Yield of all of the Projects immediately prior to the release. In order to achieve compliance with the foregoing, Borrowers may elect to make an additional principal prepayment, to be applied to the Term Loan, subject to the terms and conditions of Section 1.6 above and the payment of the applicable Exit Fee on such additional prepayment.

Closeout Phase • Attend punch list walk-through – date to be determined. • Monitor punch list progress – dates to be determined. • Review contractor submitted closeout documents – date to be determined. • Recommend issuance of Initial Acceptance – date to be determined. • Submit as-built documents – within thirty [30] of Calendar Days following issuance of Initial Acceptance to construction contractor. Warranty Phase • Assist Xxxxxxxx with obtaining warranty repairs as needed – dates to be determined.

  • Projects The Annexes attached hereto describe the specific projects and the policy reforms and other activities related thereto (each, a “Project”) that the Government will carry out, or cause to be carried out, in furtherance of this Compact to achieve the Objectives and the Compact Goal.

  • Project Budget A Project Budget shall be prepared and maintained by Grantee. The Project Budget shall detail all costs for which the Grant will be used during each calendar month of the Term. The Project Budget must be approved in writing by the Project Monitor. Grantee shall carry out the Project and shall incur costs and make disbursements of funds provided hereunder by the Sponsor only in conformity with the Project Budget. The current approved Project Budget is contained in Attachment B. Said Project Budget may be revised from time to time, but no Project Budget or revision thereof shall be effective unless and until the same is approved in writing by Project Monitor. The funds granted under this Grant Contract cannot be used to supplant (replace) other existing funds.
