Section 3.6. 35 Each employee reserves and retains the right to delegate any right or duty contained in this Agreement, 36 exclusive of compensation for services rendered, to appropriate officials of the Association. 37
Section 3.6. 6 In the event the supervisor believes the employee’s performance needs improvement, the supervisor 7 and the employee shall jointly develop a written plan of improvement. Once the plan is written, the 8 employee will have 30-90 calendar days to demonstrate improvement as laid out in the plan or he/she 9 may be subject to progressive discipline.

Section 3.6. 15 Employees subject to this Agreement have the right to have Association representatives or other persons 16 present at discussions between themselves and supervisors or other representatives of the District as 17 hereinafter provided.

An 38 employee shall have the right, upon reasonable notice, to inspect the contents of his or her personnel 39 file. Inspection shall be in the presence of a District representative at all times. File materials shall be 40 reproduced for the employee as promptly as is feasible at employee expense. An Association 41 representative may, at the employee's request, be present during the review. The employee may 42 authorize the Association, in writing, to review the personnel file on their behalf. This section does not 43 exclude a supervisor from maintaining their own working files, as they desire. At the request of an 44 employee, a working file can be reviewed annually by the employee with their supervisor. At the 45 written request of an employee, items of concern may be removed after three (3) years at the 46 supervisor’s discretion.

Section 3.6. 20 All employees subject to this agreement required to work during scheduled Association meetings shall 21 be allowed up to ninety (90) minutes off to attend such meetings to a maximum of one time per month; 22 provided, that such employee make up such time at the end of his/her shift; and provided further, that 23 such meetings shall not interfere with scheduled activities in the District, as determined by the 24 administration.
Section 3.6. 35 The District will evaluate at least once each year the performance of all employees. Employees shall be 36 allowed to attach written comments to the evaluations; such comments will become a part of the 37 evaluation. In circumstances where the evaluation of an employee is found to be unsatisfactory, the 38 employer shall provide to the employee specific recommendations on how the employee might 39 improve his/her job performance. The evaluation forms shall be attached to this Agreement as an 40 appendix.
