Section 2.3. 20 Employees subject to this agreement have the right to have Union representatives or other persons 21 present at discussion which may lead to disciplinary action between themselves and supervisors or 22 other representatives of the District.
Section 2.3. 8 The right to make reasonable rules and regulations shall be considered acknowledged functions of the 9 District. In making rules and regulations relating to personnel policies, procedures and practices, and 10 matters of working conditions, the District shall give due regard and consideration to the rights of the 11 Association and the employees and to the obligations imposed by this agreement.
Section 2.3. 37 The exercise of these rights which are not in direct conflict with a specific provision of the Agreement 38 shall not be subject to the grievance procedure. 39
Section 2.3. Section 2.3 of the Credit Agreement is hereby amended and restated in its entirety to read as follows:

Section 2.3. Section 2.3 of the Agreement is hereby amended by deleting subsection (a)(viii) and subsection (b)(iii) each in their entirety and renumbering subsection (a)(ix) to (a)(viii).
Section 2.3. 2 Employees subject to this agreement have the right to have Union representatives present at 3 discussions between themselves and supervisors or other District representatives when such 4 discussions are likely to result in disciplinary action by the District against that employee.
