Pre-Grievance Stage. Should any grievance arise between any Employee and the Employer as to the interpretation, application, administration or alleged violation of this Agreement or as to working conditions, the Employee shall discuss such complaint with her immediate Supervisor and an xxxxxxx effort will be made to settle such grievance without undue delay. Failing settlement of such complaint by discussion, it will be dealt with in accordance with Articles 10.03 – 10.06.

Pre-Grievance Stage. It is the mutual desire of the parties hereto that complaints of employees shall be adjusted as quickly as possible, and it is understood that an employee has no grievance until she has first given her supervisor the opportunity of adjusting her complaint. Such complaint shall be discussed with the supervisor within ten (10) calendar days after the circumstances giving rise to the complaint have occurred or ought reasonably to have become known to the employee. If the complaint is not settled through timely discussion with the supervisor, the complaint shall be taken up as a grievance within ten (10) calendar days of the discussion with the supervisor in the following manner and sequence: STEP NO. 1 The employee may submit a written grievance, signed by the employee, to the supervisor. The grievance shall be on a prescribed Union form (Appendix B) and shall identify the nature of the grievance, a statement of the facts giving rise to the grievance, the provisions of the Agreement that are alleged to have been violated, and the remedy that is sought. The supervisor will deliver the decision in writing within five (5) calendar days following the day on which the grievance was presented to the supervisor. The parties may, if they desire, meet to discuss the grievance at a time and place suitable to both parties. Failing settlement, then: STEP NO. 2 Within ten (10) calendar days following the decision in Step No. 1, the grievance may be submitted in writing to the Executive Director or designate. A meeting will then be held between the Executive Director or designate and the Grievance Committee within ten (10) calendar days of the submission of the grievance at Step No. 2, unless extended by agreement of the parties in writing. It is understood and agreed that a representative of the Ontario Nurses' Association will be present, and the grievor may be present at the meeting. The decision of the Employer shall be delivered in writing within five (5) calendar days following the date of such meeting. A copy of the second step grievance reply will be provided to the Labour Relations Officer. NOTE: It is understood that at any stage of the grievance process, including pre-grievance, or any disciplinary meeting, a member of the Union shall have the right to have a representative of the Union present. Pre-Grievance Stage. Member(s) should first present a potential grievance orally and informally at the lowest administrative level having the authority to dispose of it. This will usually be the Department Chair or equivalent. Members are encouraged to seek the assistance of the Association and/or the Office of Ethical Behaviour and Human Rights in an attempt to settle the potential grievances informally. For potential Association grievances, the Association President should discuss the issues with the Vice-President, Academic and Xxxxxxx and, when mutually agreeable, bring the issues to the Faculty Relations Committee, in an attempt to settle them informally. The use of informal means to resolve a dispute does not, without the written consent of the potential grievor and the Vice-President, Academic & Xxxxxxx (VPA&P), extend the time available to commence the formal grievance process.

  • Grievance Steps Grievances shall be handled in the following manner: Step One: The grievant, advocate and/or Union staff representative shall present a grievance orally to the grievant’s immediate supervisor within fifteen (15) calendar days from the date of the occurrence of the facts or from the date the alleged violation first became known, whichever is later. The supervisor shall respond in writing to the grievance within ten (10) calendar days of the presentation to agree to resolve the grievance or to deny the grievance. The supervisor’s response shall be addressed to both the grievant and the Union. Should the supervisor fail to respond within this time frame, the Union shall have the right to forward the grievance to the next step. Step Two: If no resolution or settlement is reached between the grievant and the supervisor, the grievant or the Union may file a written appeal of the supervisor’s decision rendered in Step One to the appropriate Program Director or his/her designated representative. The grievant or Union shall file this written grievance within fifteen (15) calendar days after his/her receipt of the supervisor’s decision from Step One. A meeting with the appropriate Program Director or his/her representative, the grievant and the advocate or Union staff representative shall be held not later than ten (10) calendar days after receipt of the written grievance. The appropriate Program Director’s response shall be addressed to the grievant and the Union. The appropriate Program Director’s response shall be final and binding on the employee, the Union, and the Employer unless it is timely appealed to arbitration by the Union in accordance with this Article. Grievances concerning discharge or discrimination, or grievances filed by the Union shall be filed initially at Step Two. Group grievances claiming the same alleged conduct involving employees who work under more than one supervisor may be filed initially at Step Two. Multiple individual grievances alleging the same violation that are filed during the same time frame may be combined into a group grievance and commenced at Step Two.

  • Year-End Grievance In the event a grievance is filed at such time that it cannot be processed through all steps in this grievance procedure by the end of the school year and, if left unresolved until the beginning of the following school year, could result in irreparable harm to a party in interest, the time limits set forth herein shall be reduced so that the grievance procedure may be exhausted prior to the end of the school year or within a maximum of 30 days thereafter. Reduction of the time limit shall be with mutual consent.

  • Grievance Initiation 33. a. A grievance affecting more than one employee shall be filed with the departmental official having authority over all employees affected by the grievance.

  • CENTRAL GRIEVANCE PROCESS The following process pertains exclusively to grievances on central matters that have been referred to the central process.   • Policy Grievance – Employer Grievance The Employer may institute a grievance alleging a general misinterpretation or violation by the Union or any employee by filing a written grievance with the Bargaining Unit President, with a copy to the Labour Relations Officer within twenty (20) days after the circumstances have occurred. A meeting will be held between the parties within ten (10) days. The Union shall reply within ten (10) days after the meeting, and failing settlement, the matter may be referred to arbitration.

  • Grievance Mediation a) At any stage in the grievance procedure, the parties by mutual consent in writing may elect to resolve the grievance by using grievance mediation. The parties shall agree on the individual to be the mediator and the time frame in which a resolution is to be reached.

  • Grievance Process In the event of any dispute arising in connection with any part of this clause, such a dispute shall be processed in accordance with the dispute settling provisions of this Agreement.
