Level 2. If the grievant is not satisfied with the written answer at Xxxxx 0, the grievant may, within seven (7) days from the receipt of such answer, file a written appeal by hand delivery or by e-mail (with confirmation of delivery) to the department head. Within seven (7) days of receipt of the written appeal, the department head or his/her designee, shall investigate the grievance, which may include a meeting with the concerned parties and thereafter provide a written response to the grievant with seven (7) days.
Level 2. A. If the discussion with the supervisor does not resolve the potential grievance to the satisfaction of the employee, such employee shall have the right to lodge a written grievance, on a form provided by the district, with the Superintendent within five (5) working days following the decision by the supervisor. The grievance shall be submitted on the standard Grievance Form and copies will be submitted to the appropriate supervisor and to the Superintendent. The grievance will contain a concise statement of the facts upon which the grievance is based, including the specific section of this agreement that has been violated, specify the manner in which it was violated, and the relief sought, as well as the disposition by the supervisor. If no hearing is requested, the Superintendent shall notify the employee in writing of his decision and the reasons for such decision within five (5) working days following receipt of the grievance.
Level 2. If the grievant is not satisfied with the disposition of the grievance, or if no disposition has been made within five (5) days, the grievance shall be transmitted to the Superintendent. Within fifteen (15) days of receipt of the grievance, the Superintendent shall indicate the disposition of the grievance, in writing, to the grievant and the Association. The Superintendent or the Association may request a hearing be held with the grievant prior to a decision being rendered.
Level 2. If the grievance shall not have been disposed of to the Member’s satisfaction within five (5) working days after submission to Xxxxx 0, the grievance may be filed in writing with the Superintendent, who shall within five (5) working days after stamped receipt of the Level 2 grievance, meet with the aggrieved Member and /or a representative from the Association in an effort to settle the grievance. The Superintendent’s determination of the grievance shall be in writing to the grievant.
Level 2. If the Association is not satisfied with the decision of the appropriate administrator, or if no decision has been delivered in the time allowed in Section 1, written notice of appeal signed by a representative of the Association shall be delivered to the Superintendent or his/her designee within ten (10) calendar days thereafter. Within fourteen (14) calendar days of receipt of such notice, the Superintendent or his/her designee shall meet with the grievant and a representative of the Association in an effort to settle the grievance. The Superintendent or his/her designee shall deliver his/her decision in writing to the grievant and the Association’s representative within fourteen (14) calendar days after such meeting.
Level 2. In the event the grievant is not satisfied with the decision at Xxxxx 0, xx/xxx must appeal the decision to the Superintendent or designee within ten (10) days. This document shall include a copy of the original grievance, the decision rendered, and a clear, concise statement of the reasons for the appeal. The Superintendent or designee shall communicate his/her decision within ten (10) days after receiving the appeal. Either the grievant or Superintendent or designee may request a personal conference within the above time limits. If the Superintendent or designee does not respond with the time limits, the grievant may appeal to the next level. If the grievance arises from an act or omission on the part of a member of management at a level above the principal or immediate supervisor, the grievant shall submit such grievance in writing at Level 2. If the grievance involves more than one employee or employees with different immediate supervisors, the grievance may be filed at Level 2.
Level 2. Within five (5) days of the discussion at Xxxxx 0, the Employee must notify the Association Grievance Committee representative of any dissatisfaction and must submit his/her grievance in writing to his/her immediate supervisor on the form provided. The immediate supervisor shall sign and date all copies when he/she receives them. If the grievance does not involve the immediate supervisor, it may be filed at Level 3. The immediate supervisor shall respond in writing to the grievance within ten (10) days of receipt of the grievance.
Level 2. If the grievance is not resolved in Level l, the teacher and/or the Exclusive Representative must present the grievance, in writing, within five days, to the Superintendent who will then arrange a meeting within five days. The teacher and/or the Exclusive Representative and the Superintendent shall be present at the meeting. The Superintendent must provide the aggrieved teacher with a written answer to the grievance within five days.
Level 2. If, after the informal discussion with the immediate supervisor, the employee, and the SMEA are dissatisfied with the disposition of the grievance at Xxxxx 0, they may jointly invoke the formal grievance procedure by filing a formal written grievance on a grievance form signed by both the grievant and an authorized representative of the SMEA, which form shall be available to employees from the SMEA representatives. The grievance form shall be filed with the employee's immediate supervisor not later than ten (10) days after receipt of the supervisor's disposition at Level 1 or expiration of the time for Level 1 response, whichever shall be earlier.
