Level 2. If the grievant is not satisfied with the written answer from his/her manager the grievant may, within ten (10) days from the receipt of such answer, file a written appeal to the appointing authority. Within ten (10) days of the receipt of the written appeal the appointing authority shall investigate the grievance, which shall include a meeting with the concerned parties, and thereafter shall give a written answer to the grievant within ten (10) days.
Level 2. A. If the discussion with the supervisor does not resolve the potential grievance to the satisfaction of the employee, such employee shall have the right to lodge a written grievance, on a form provided by the district, with the Superintendent within five (5) working days following the decision by the supervisor. The grievance shall be submitted on the standard Grievance Form and copies will be submitted to the appropriate supervisor and to the Superintendent. The grievance will contain a concise statement of the facts upon which the grievance is based, including the specific section of this agreement that has been violated, specify the manner in which it was violated, and the relief sought, as well as the disposition by the supervisor. If no hearing is requested, the Superintendent shall notify the employee in writing of his decision and the reasons for such decision within five (5) working days following receipt of the grievance.
Level 2. If the grievant is not satisfied with the disposition of the grievance, or if no disposition has been made within (5) school days, the grievance shall be transmitted to the Superintendent. Within fifteen (15) school days of the receipt of the grievance, the Superintendent shall indicate a disposition of the grievance in writing to the Paraprofessional and the Association. The Superintendent may, at his/her option or at the request of the Asso- ciation, hold a hearing prior to rendering a decision.
Level 2. Within five (5) days of the discussion at Level 1, the Employee must notify the Association Grievance Committee representative of any dissatisfaction and must submit his/her grievance in writing to his/her immediate supervisor on the form provided. The immediate supervisor shall sign and date all copies when he/she receives them. If the grievance does not involve the immediate supervisor, it may be filed at Level 3. The immediate supervisor shall respond in writing to the grievance within ten (10) days of receipt of the grievance.
Level 2. If the grievant is not satisfied with the written answer from Level 1, the grievant may, within seven (7) days from receipt of such answer, file his or her written grievance with the Sheriff with a copy to the County’s Personnel Officer. Within fourteen (14) days of receipt of the written grievance, the Sheriff, or his/her designee, shall investigate the grievance which may include a meeting with the concerned parties and, thereafter give written answer to the grievant within fourteen (14) days. Level 3: If the grievant is not satisfied with the written answer from Level 2, the grievant may, within seven (7) days from the receipt of such answer, file a written appeal to the County Commissioners. Within fourteen (14) days of receipt of the written appeal, the County Commissioners, or their designee, shall investigate the grievance, which may include a meeting with the concerned parties, and, thereafter, give written answer to the grievant within seven (7) days, which answer shall be final and binding unless, within fourteen (14) days, the grievant notifies the County Commissioners of his/her intention to appeal the matter to the External Hearing Officer. Minor Disciplinary Actions shall not be appealable to an External Hearing Officer.
Level 2. If, after the informal discussion with the immediate supervisor, the employee, and the SMEA are dissatisfied with the disposition of the grievance at Level 1, they may jointly invoke the formal grievance procedure by filing a formal written grievance on a grievance form signed by both the grievant and an authorized representative of the SMEA, which form shall be available to employees from the SMEA representatives. The grievance form shall be filed with the employee's immediate supervisor not later than ten (10) days after receipt of the supervisor's disposition at Level 1 or expiration of the time for Level 1 response, whichever shall be earlier.
Level 2. If not satisfied with the decision at Level 1, the grievant may, within ten (10) days, appeal the decision on the appropriate form to the Superintendent or designee. This statement shall include a copy of the original grievance and appeal and the decision rendered at the previous level. The Superintendent or designee shall communicate the decision to the grievant and to the Association President within ten (10) days. If the Superintendent or designee does not respond within the time limits provided, the grievant may appeal to the next level. Within the above time limits, either party may request and shall be granted a personal conference.
Level 2. If the grievance is not resolved in Level l, the teacher and/or the Exclusive Representative must present the grievance, in writing, within five days, to the Superintendent who will then arrange a meeting within five days. The teacher and/or the Exclusive Representative and the Superintendent shall be present at the meeting. The Superintendent must provide the aggrieved teacher with a written answer to the grievance within five days.
Level 2. If the Association is not satisfied with the decision of the appropriate administrator, or if no decision has been delivered in the time allowed in Section 1, written notice of appeal signed by a representative of the Association shall be delivered to the Superintendent or his/her designee within ten (10) calendar days thereafter. Within fourteen (14) calendar days of receipt of such notice, the Superintendent or his/her designee shall meet with the grievant and a representative of the Association in an effort to settle the grievance. The Superintendent or his/her designee shall deliver his/her decision in writing to the grievant and the Association’s representative within fourteen (14) calendar days after such meeting.
