Lease of Personal Property. Landlord shall lease to Tenant such personal property on the Premises as shall be reflected in an Addendum attached to this Lease which Addendum shall set forth the terms and conditions of the Lease of said personal property.

Lease of Personal Property. Lessor hereby demises, leases and lets the Personal Property to Lessee, and Lessee rents, leases and hires the Personal Property from Lessor, in accordance with the provisions of this Agreement, for the Lease Term.

Lessee agrees to indemnify and hold Lessor and Lessor’s agents, employees, officers, and directors harmless from and against, any and all Claims, including any and all attorneys’ fees and legal expenses, arising from or caused directly or indirectly by any actual or alleged use, possession, maintenance, condition (whether or not latent or discoverable), operation, location, delivery or transportation of any of the Personal Property. This indemnity remains in full force notwithstanding the termination or expiration of this Lease, but will be released as to the original Lessee at the time of any Transferee’s assumption of this Lease and release of original Lessee if provided pursuant to Section 16.1.C.
Lease of Personal Property. During the Term of this Lease, Tenant shall be entitled to use the fixtures, trade fixtures, equipment, machinery, furnishings, appliances, and items of personal property owned by Landlord and located in the Premises as the same will be identified in a list to created by Landlord and Tenant (the “FF&E”) at no additional cost or expense. Landlord makes no representation or warranty about the quality and/or condition of the FF&E and Tenant shall be solely responsible for maintaining, repairing and replacing the FF&E during the Term of this Lease. Tenant agrees to surrender to Landlord, at the end of the Term of this Lease and/or upon any cancellation or early termination of this Lease, the FF&E in as good condition as the FF&E was in at the beginning of the Term of this Lease, ordinary wear, tear and casualty excepted and otherwise in accordance with the terms of Section 25 of this Lease. The parties acknowledge and agree that the Tenant’s Property is excepted from the provisions of this Section, and that Tenant shall have the right to remove the Tenant’s Property from the Premises at the end of the Term and/or upon the cancellation or early termination of this Lease.

Lease of Personal Property. Schedule 2.01(f) attached hereto describes all leases of equipment and vehicles used in or relating to the Business. Complete and correct copies of those leases have been provided to the Purchaser. The Vendor is entitled to all rights and benefits as lessee under those leases, and the Vendor has not sublet, assigned, licensed or otherwise conveyed any rights in those licenses or in the property leased thereunder to any other person. Other than as disclosed in the Assumed Liabilities, all payments and other obligations required to be paid and performed by the Vendor under those leases have been duly paid and performed; the Vendor is not in default of any its obligations under those leases; and, to the best of the knowledge of the Vendor and SoftQuad, none of the lessors or any other parties to those leases are in default of any of their obligations under those leases. The Vendor is entitled to assign all of its right and interest under those leases and in and to the property leased thereunder to the Purchaser, subject to obtaining the consents referred to in Schedule 3.01(3) attached hereto. Subject to obtaining such consents, the terms and conditions of those leases will not be affected by, nor will any of those leases be in default as a result of, the completion of the transaction contemplated hereunder.

Lease of Personal Property. The Department hereby leases to the Corporation on an “as is” basis those certain items of personal property which are related to activities conducted by the Corporation under this GCEP Lease and are described in Exhibit B (“GCEP Leased Personalty”). When added to Exhibit B, the Corporation will become responsible for complying with applicable Regulatory Agency and GCEP Lease requirements, including the removal and/or disposal of all radiological contamination, and for the disposal of all personalty described in Exhibit B at the end of the personalty’s useful life, or at the termination, revocation, or expiration of this GCEP Lease, whichever occurs first. The Department will have the right, at its sole option, to transfer to the Corporation the title to individual items of the GCEP Leased Personalty and remove them from Exhibit B during the GCEP Lease Term. Prior to the Corporation’s disposal of GCEP Leased Personalty described in Exhibit B, the Corporation will obtain the Department’s written approval of a Disposition Plan appropriate to the sensitivity of the material proposed for disposal. The Corporation shall be responsible for all costs associated with GCEP Leased Personalty disposition and any necessary radiation surveys performed prior to public release of the property. Upon disposition, all Trigger List and Classified Property as defined in 41 C.F.R. § 109 shall be destroyed in accordance with 41 C.F.R. § 109 and Department direction. All other GCEP Leased Personalty shall be disposed of in accordance with 41 C.F.R. §109, except as otherwise authorized by the Department. The Department retains the option to require the return of individual items of GCEP Leased Personalty to Department control after the Corporation complies with the Turnover Requirements as set forth in Section 4.4.
Lease of Personal Property. Landlord leases to Tenant, and Tenant leases from Landlord, on the terms and conditions set forth in this Lease, the furniture, fixtures, and equipment specifically listed on Exhibit C attached hereto and by this reference incorporated herein (the “Personal Property”, and together with the Premises, collectively the “Property”). Tenant acknowledges and agrees that the Personal Property shall be located at all times during the Term at the Premises, and shall not be moved without Landlord’s prior written consent in each instance, in its sole discretion. Notwithstanding anything to the contrary set forth in this Lease, Landlord shall not be obligated to replace any Personal Property, whether due to permanent damaged, obsolescence, or otherwise, and Tenant shall be solely responsible for obtaining and maintaining its own replacement personal property to satisfy its needs at the Premises, which replacement personal property shall be and remain the property of Tenant if obtained by Tenant.
Lease of Personal Property. Notwithstanding anything contained herein or in any security agreement or any other document executed by Borrower in favor of Bank ("Loan Documents"), the Borrower is hereby permitted to rent and or lease personal property and to execute such documents as necessary to effect such transactions, including the granting of a purchase money security interest if the property being rented or leased. Any such rental or lease will not be a violation of any of the Loan Documents.
