Renter hereby releases, covenants not to sue, discharges, and agrees to fully indemnify, defend and hold harmless the Encino Park HOA, Spectrum Association Management, LP, and all of their respective agents, managers, officers, directors, partners, members, employees, contractors and representatives of and from any and all damages, claims, costs, expenses, liabilities, causes of action, loss of personal property, and/or any bodily injury of any kind arising out of or related in any way to this agreement and/or the usage of the Community Center, including but not limited to any claims related in any way to COVID-19. Xxxxxx understands and agrees that this agreement to release, indemnify and defend includes any and all claims based in whole or in part on the actions, omissions, or negligence of the Encino Park HOA, Spectrum Association Management, LP, and their respective agents, managers, officers, directors, partners, members, employees, contractors and representatives. By signing this agreement, you acknowledge and understand that you are personally responsible for any damage, sickness, or injury to yourself and/or any guest or individual present on the Association's Property as a result of your use of the Community Center. You further understand and agree that your period of responsibility begins once you enter the Encino Park HOA property and/or once your usage time starts, whichever comes first, and does not end until you and all your guests have left the Encino Park HOA property. You also acknowledge and understand that if you serve alcohol, you are completely responsible for any action or inaction, which is caused as a result of serving alcohol. COVID Protocols. The District requires that buses shall be sprayed down in between routes and the District can supply sufficient cleaning products to accomplish said cleaning to be done by the Carrier’s employees. Drivers and passengers shall wear face masks.
COVID Protocols. Currently, Mansfield Ski Club does not have any requirements for masking, proof of vaccination or social distancing restrictions. Our club will follow all recommendations and rules from Public Health as they change, and new requirements may be implemented or changed at any time throughout the year. Ski and Snowboard Lessons Reciprocal club guests are welcome to book private and semi-private lessons at Mansfield Ski Club. A Letter of Introduction must be received at the Club before any lessons can be booked. Once we have received your Letter, we will contact you will arrival information and how to request a lesson. Private lessons are based on availability and do sell out typically at least 2- weeks in advance. We do not book lessons on the day of your visit. Private lessons are subject to a 48-hour cancellation policy. No shows or cancellations within the 48-hours will not be refunded or rescheduled for any reason. A valid lift ticket is required for all lessons. Upon Arrival at Mansfield Ski Club Upon arrival at our club, please check in at Front Desk in the Main Chalet to purchase your guest tickets. All guest ticket fees, dining charges, lessons and rental fees must be paid at time of purchase via debit card, Visa or Mastercard. We are now a cashless club. Payments made via a Visa or Mastercard are subject to a 2.4% credit card recovery fee. Dining charges are subject to a 15% gratuity in our alcohol service areas. COVID Protocols. (a) While on Client property or using Client facilities, Contractor will strictly follow all health and safety guidelines, rules, recommendations and related information provided by Client or published by federal, state/provincial and local governmental authorities with jurisdiction over Client’s operations in connection with preventing the spread of the novel coronavirus (collectively, the “COVID Protocols”). Client’s COVID Protocols as of the effective date hereof are attached hereto as Schedule 1 and may be amended, replaced or supplemented at any time by Client upon notice (including e-mail) to Contractor. In the event of any conflict between COVID Protocols provided by Client and COVID Protocols published by said governmental authorities, the more stringent and protective of the two will control and take precedence.
