ARTICLE MANAGEMENT GRIEVANCES. It is understood that the Employer may bring forward at any meeting held with the Union Grievance Committee any com- plaint with respect to the conduct of the Union, its officers or stewards, and that if such complaint by the Employer is not settled to the mutual satisfaction of the conferring parties it may be treated as a grievance and referred to Arbitration in the same way as the grievance of an employee.

ARTICLE MANAGEMENT GRIEVANCES. It is understood that the Corporation may bring forward at any meeting with the Union Committee any complaint or grievance, and that if such complaint or grievance is not settled to the mutual satisfaction of the conferring parties, it may be referred to Arbitration as set out in the Arbitration provisions.

If final settlement of the grievance is not completed within five working days of such meeting, the grievance may be referred, by either party, to an Arbitrator as provided in Article at any time within ten calendar days thereafter, but not later. ARTICLE DISCHARGE CASES A claim by an employee who has completed the probationary period that has been discharged without just cause shall be treated as a grievance if a written statement of such grievance is lodged with the Manager of Retail Operations at Step No. of the grievance procedure within three (3) working days after the employee ceases working for the Company. Such special grievances may be settled by: confirming the Management’s action in dismissing the employee; or reinstating the employee with full compensation for time lost; or any other arrangement which is just and equitable in the opinion of the conferring parties or the Arbitrator. When an employee has been dismissed without notice, the employee shall have the right to interview a xxxxxxx for a reasonable period of time before leaving the store premises.

A Union policy grievance which is defined as an alleged violation of this Agreement concerning all or a substantial number of the employees in the bargaining unit in regard to which an individual employee could not grieve or in regard to which a substantial number of employees have signified an intention to grieve, may be brought forward by the Union Grievance Committee, in writing, at Step No. of the Grievance Procedure at any time within five (5) working days after the circumstances giving rise to such policy griev- ance occurred or should reasonably have become known to the Union and if it is not settled at this stage, it may go to Step No. of the Grievance Procedure and ultimately to the same manner as a grievance of an employee. The parties agree that the principle of progressive disci- xxxxx shall be followed. Normally, before an employee is sus- pended or discharged an interview between the employee, a management representative and a union representative will take place, but if there is no such interview prior to the sus- pension or discharge, such an interview will take place within two (2) working days thereafter.
