Tenant shall be obligated to accept the Premises at such time as the Premises are Substantially Complete as defined herein, even though certain other portions of the Building or the Project which do not interfere with Tenant’s efficient conduct of its business may not have been fully completed, and even though Tenant’s furniture, fixtures, and/or equipment may not have been installed.
Notwithstanding the foregoing, the Premises may be deemed to be Substantially Complete without a certificate of occupancy so long as Tenant may lawfully occupy the Premises for the Permitted Use.
If such delays are due to Tenant Delays, the Commencement Date shall be the date on which Landlord could reasonably have been expected to Substantially Complete the Tenant Improvements and deliver possession of the Premises to Tenant but for any Tenant Delays.
