Punch List Items definition

Punch List Items means such items (i) as are reasonably necessary or appropriate to fully complete the construction, equipping and furnishing of the Hotel in accordance with this Contract and (ii) that, unless otherwise agreed by Buyer in its sole discretion, (a) individually and in the aggregate do not and will not prohibit, cause a delay in or otherwise adversely affect, under applicable Legal Requirements, the Franchise Agreement or otherwise, the opening of the Hotel for business to the public or the continued occupancy and operation of the Hotel as contemplated under the Brand and (b) may be corrected or completed, subject to delays caused by Force Majeure, within not more than sixty (60) days.
Punch List Items means items of works of a minor or snagging nature which do not affect beneficial occupation or use of the Works by WAPCOS Limited, or other users and, where agreed with WAPCOS Limited, any other works which remain incomplete at the Date of Completion of the Works.
Punch List Items means uncompleted or improperly completed items of the Tenant improvements which, in the aggregate, do not materially interfere with Tenant’s occupancy of the Premises for the Permitted Use, as reasonable determined by Landlord and Tenant. If Tenant Delays exist, as reasonably determined by Landlord, then upon the Substantial Completion of the Tenant Improvements, Landlord shall notify Tenant of (i) the aggregate period of the Tenant Delays and (ii) the Expansion Date as determined pursuant hereto. Tenant shall, within five (5) days following receipt of such notice, perform or cause to be performed all obligations under the Lease (including, without limitation, the payment of Rent) that have accrued from the Expansion Date, as determined pursuant hereto, to the data on which Tenant received Landlord’s notice, and the Expansion Date shall, for all purposes under this Lease, be the Expansion Date as determined pursuant hereto. Nothing contained herein shall be deemed to relieve Landlord of its obligation to use commercially reasonable efforts to complete the Tenant Improvements in a timely manner, subject to Tenant Delays and delays due to the occurrence of any Force Majeure Event. The time for performance by either party of any obligation under this Lease (other than the payment of rent or other monetary obligations) shall be extended for the period of delay resulting from fire, earthquake, explosion, flood, the elements, acts of God or the public enemy, strike, other labor trouble, interference of governmental authorities or agents, or shortages of fuel, supplies or labor resulting therefrom or any other cause, whether similar or dissimilar to the above, beyond the reasonable control of the party obligated for such performance, financial inability except...
