Spare Equipment. The lift tools, tackles, consumables and other general purpose equipment required for the general maintenance of the plant should be supplied as Specified in Clauses Mechanical spares and Electrical spares of Section V, Technical Specifications for Plant Components. The equipment shall be treated as over and above the essential spares that form part of the critical equipment such as Flash Chamber, Condenser, Sea Water Pumps, Vacuum System, Fresh Water Pumps.

Spare Equipment. The Lessor leases the equipment specified here to the Lessee, who must comply with the terms of this Agreement. Spare Equipment. The Contractor shall maintain adequate storage and shop repair facilities to perform the Agreement, including a sufficient stock of spare parts, standby controllers and signal equipment to effect permanent repairs to the system within a thirty (30) day period. Failure to effect permanent repairs within this time limit may be sufficient cause for the City to authorize repairs to be completed by others. Repetitive failure shall be sufficient cause to the City to terminate the Agreement. The Contractor shall be responsible for furnishing all spare standby controllers necessary to maintain the continued safe and efficient operation of the signal system whenever the original unit is withdrawn for maintenance, repair or modification. Standby controllers shall be fully compatible with the City’s traffic control system without exception. All component parts (detectors, load switches, phones, lights, signal monitors, etc.) of each system shall be maintained at all times to perform the functions for which they were designed unless authorized to the contrary by the Public Works Department.

In no event will Horizon, its subsidiaries, associated companies, or suppliers, be liable to customer or any users for special, consequential, exemplary, incidental, or indirect damages or costs (including legal fees and expenses) or loss of goodwill or profit in connection with any claim arising from this agreement, regardless of the form of claim or action, even if Horizon, its subsidiaries, associated companies, or suppliers, has been advised of the possibility of such damages or costs. MAINTENANCE COVERAGE AFTER THE SERVICE PERIOD After the Service Period, customers can return the defective item to an authorized repair facility for repair. The cost for these repairs will be billed at the then prevailing labor rate per hour plus the cost of all required parts. Estimates, including a one-hour minimum for labor and/or problem diagnosis will be furnished to the customer before any work is performed.
