Repair Facilities. Repair facilities that will perform the warranty work of items under this Contract shall be identified as listed on the Contractor’s dealer network. As the manufacturer, the Contractor is responsible for ensuring that the facilities adhere to the contract requirements for warranty work performance.
Repair Facilities. Contractor may own and/or operate one or more Repair Facilities. If Contractor owns and/or operates more than one Repair Facility, each Repair Facility which is subject to the terms of this Agreement shall be listed in a Multiple Repair Facilities Rider and attached to this Agreement. Repair Facilities not so listed on the attached Multiple Repair Facilities Rider are not included in the Program. As to each Repair Facility so listed, Contractor will provide to Progressive, and update as and when necessary, the address of such Repair Facility, days and hours of operation, the identity of the management personnel and shop liaison at such facility and other pertinent information. Each Repair Facility must maintain the capabilities and equipment described in this Article IV, and ensure that its personnel meet the qualifications and complete the training set forth in Section 3.3 above.

Repair Facilities. Vessels of cither country calling for urgent repairs on route will be allowed to have repairs done at the Government owned or any reputed marine workshop in cither country with the prior permission of the respective Competent Authority. The expenditure incurred on such repairs will be reported by the operators to the concerned foreign exchange authorities for their clearance in accordance with the provisions of Article 25.

As of the Effective Date, the Inspection Report(s) have not been completed. Notwithstanding anything to the contrary contained in the Master Lease, as hereby amended, Lessee shall be solely responsible and hereby covenants to timely complete all repair and maintenance work to the Repair Facilities set forth in the Inspection Report(s) (the “Inspection Report Work”) in good and workmanlike manner, and otherwise in the manner required pursuant to Article IX of the Original Master Lease, on or before the date that is one hundred eighty (180) days following the completion of such Inspection Report(s) by Epic Consulting, Inc. Lessee shall deposit with Lessor into a reserve account maintained by Lessor (the “Inspection Work Reserve”) an amount equal to fifty percent (50%) of the estimated cost of the Inspection Report Work, as reasonably determined by Lessor based upon the Inspection Report(s) and the relevant market for such work (the “Inspection Work Reserve Amount”). As of the Effective Date, Lessor and Lessee estimate that the Inspection Work Reserve Amount will equal Three Hundred Fifty Thousand Dollars ($350,000.00) (the “Estimated Inspection Work Reserve Amount”), and Lessee shall, on the Effective Date, deposit the Estimated Inspection Work Reserve Amount with Lessor. If it is determined upon completion of the Inspection Report(s) that (i) the Inspection Work Reserve Amount is greater than the Estimated Inspection Work Reserve Amount (plus interest thereon as provided below), Lessee shall promptly deposit with Lessor an additional amount equal to the difference between the actual Inspection Work Reserve Amount and the Estimated Inspection Work Reserve Amount (plus interest thereon as provided below) or (ii) the actual Inspection Work Reserve Amount is less than the Estimated Inspection Work Reserve Amount, Lessor shall promptly refund to Lessee an amount equal ...
