Service Provider’s Staff. 16.1 Access to the Premises shall be limited to such Staff and the SERVICE PROVIDER’S suppliers as are necessary for the SERVICE PROVIDER to fulfil its obligations under the Contract. Service Provider’s Staff. 9.1.1 The Service Provider shall at all times during the Term ensure that its employees engaged in the provision of the Services have sufficient skill and ability and have been properly trained in order to carry out the Services in accordance with this Agreement;
Service Provider’s Staff. 13.1.The Service Provider warrants and represents that all Staff assigned to the performance of the Services shall possess and exercise the skill and experience, qualifications and expertise necessary for the proper performance of the Services.
Service Provider’s Staff. 18.1 The Service Provider shall at all times during the Contract Period employ sufficient persons of sufficient abilities and skills for the proper performance of the Services. In particular the Service Provider shall provide sufficient currently qualified staff to undertake all activities in accordance with all appropriate statutes, regulations and case law to ensure, amongst other things, that employees and members of the public are kept safe at all times.
Service Provider’s Staff. 23.1 The Service Provider shall provide sufficient trained and competent staff who have adequate skills to provide good standards of care and are able to provide the Service in accordance with the ISC, the Care Plan and Personal Plan as reviewed from time to time and the Regulatory Authority’s requirements. The Service Provider shall ensure that the staff have the appropriate competencies and must be able to demonstrate that these competencies have been specifically set out in job descriptions, person specifications and development plans. In Care Homes with Nursing the qualifications of the nursing staff shall comply with the requirements of the Regulatory Authority i.e. The Nursing and Midwifery Council (NMC).
Service Provider’s Staff. Access to the Premises shall be limited to such Staff and the SERVICE PROVIDER’S suppliers as are necessary for the SERVICE PROVIDER to fulfil its obligations under the Contract. The CLIENT reserves the right to refuse to admit to, or to withdraw permission to remain on, the Premises:- for any member of the Staff; or for any person employed or engaged by any member of the Staff, whose admission or continued presence would be, in the reasonable opinion of the CLIENT, undesirable. At the CLIENT’S written request, the SERVICE PROVIDER shall provide a list of the names and business addresses of all persons who may require admission in connection with the Contract to the Premises, specifying the capacities in which they are concerned with the Contract and giving such other particulars as the CLIENT may reasonably request. The SERVICE PROVIDER’S Staff, engaged within the boundaries of the Premises, shall comply with such rules, regulations and requirements (including those relating to security arrangements) as may be in force from time to time for the conduct of personnel when at or outside those premises. If the SERVICE PROVIDER fails to comply with Clause 16.3 within five (5) days of the date of the request and in the reasonable opinion of the CLIENT, such failure may be prejudicial to the interests of the Crown, then the CLIENT may terminate the Contract, provided always that such termination shall not prejudice or affect any right of action or remedy which shall have accrued or shall thereafter accrue to the CLIENT. The decision of the CLIENT as to whether any person is to be refused access to the Premises and as to whether the SERVICE PROVIDER has failed to comply with Clause 16.3 shall be final and conclusive. Inspection of Premises GUIDANCE: use Clause 17 where the Services, or any part of them, are to be delivered at the CLIENT’S Premises. Save as the CLIENT may otherwise direct, the SERVICE PROVIDER is deemed to have inspected the Premises and, where one is provided, the Statement of Work, and to have made appropriate enquiries so as to be satisfied in relation to all matters connected with the performance of its obligations under the Contract. The Service Provider shall additionally ensure that it engages skilled management, supervisory and, where appropriate, non-operational or custodial support Staff to manage the Service Provider's duties and obligations under the Contract.
