OWNER FURNISHED EQUIPMENT. (a) Within forty-five (45) days of the Effective Date of this Agreement, Builder and Owner shall agree upon a schedule of in-yard delivery dates of those items of material, equipment, engineering data and information ("Owner Furnished Equipment"), as are set forth in the Specifications to be provided by Owner. The time for delivery of the Owner Furnished Equipment as detailed on such delivery schedule shall be such so as to not cause Builder to be delayed in the timely prosecution of the work in accordance with the Production Schedule.
OWNER FURNISHED EQUIPMENT. DELAYS OWNER shall furnish or cause to be furnished to BUILDER at BUILDER's Shipyard those items of machinery, material and equipment as set forth in the Specifications to be furnished by OWNER (herein referred to as "OWNER Furnished Equipment" or "OFE") on or before the time specified for such delivery in the Contract Specifications (Exhibit "A"). However, BUILDER shall not require OWNER Furnished Equipment to be delivered to BUILDER's Shipyard prior to the time that said OWNER Furnished Equipment is required, in BUILDER's reasonable opinion, to meet the BUILDER's Construction Schedule, as defined herein. If OWNER's failure to timely deliver OWNER Furnished Equipment to BUILDER's Shipyard directly causes any delays in the BUILDER's Construction Schedule, then such delays shall be understood to be Permissible Delays as contemplated by Article III, Paragraph 2, and the Delivery Date shall be extended by the equivalent number of days of delay in delivery of such OWNER Furnished Equipment to BUILDER's Shipyard. (BUILDER agrees, however, to use its best efforts to proceed with its work on the VESSEL so as to minimize the delay that may be incurred by reason of late delivery of OWNER Furnished Equipment.) In order to enable BUILDER to efficiently and economically proceed with its work on the VESSEL, OWNER shall give BUILDER notice of any actual or anticipated delay in the delivery of OWNER Furnished Equipment to BUILDER's Shipyard. Should OWNER fail to timely deliver OWNER Furnished Equipment to BUILDER at BUILDER's Shipyard due to causes other than force majeure (which shall in this context have the same general meaning as the causes specified in Paragraph 1 of this Article) and such delay directly results in increased costs to BUILDER attributable to additional unavoidable physical work on the VESSEL, OWNER shall reimburse BUILDER for its actual documented cost of such additional work. BUILDER's entitlement to such reimbursement shall be applicable only in the event that BUILDER has submitted prior written notice to OWNER that the delay in delivery of OWNER Furnished Equipment will or may require additional physical work to be performed on the VESSEL.
OWNER FURNISHED EQUIPMENT. The Contractor shall perform all work required to subcontract the installation of Owner Furnished Contractor Installed (OFCI) and Owner Existing Contractor Installed (OECI) equipment.

OWNER FURNISHED EQUIPMENT. Owner shall, at its sole cost and expense, deliver the Owner-Furnished Equipment to the Site in accordance with the critical path dates identified in the Project Schedule.
OWNER FURNISHED EQUIPMENT. Within ten (10) business days from the execution of this Contract, Builder shall deliver to Owner a schedule of dates for the delivery to Builder by Owner of Owner Furnished equipment and information (the "Schedule of Delivery of Owner Furnished Equipment"). If delivery by Owner to the designated shipyard of any of the components of Owner Furnished Equipment is delayed beyond the respective scheduled dates of delivery shown on the Schedule of Delivery of Owner Furnished Equipment, it is agreed that the Stipulated Delivery Date of the affected Unit(s) shall be extended on a day for day basis for each day of delay of such Owner Furnished Equipment or such other period, whether longer or shorter, as the parties may mutually agree in writing taking into consideration the degree the Work is actually delayed by the delay of such Owner Furnished Equipment. Owner shall be responsible for all costs of transportation of Owner Furnished Equipment to the designated shipyard as well as all classification and regulatory certificates. All Owner furnished equipment arriving at Builder's yard shall be stored in a secure area allocated to Owner for storage of equipment and supplies until required by Builder for installation into the Vessels. Such securing area shall be plainly marked to indicate Owner's possession and ownership of such equipment and supplies.

Builder shall receive, store, secure and handle with reasonable care the Owner Furnished Equipment after delivery thereof at the yard and shall install in or on the Vessel at Builder's cost and expense those items of Owner Furnished Equipment as are required by the Specifications to be installed by Builder. If Owner delivers any Owner Furnished Material more than one (1) month earlier than that contemplated by the OFE Delivery Schedule, Owner shall be responsible for the reasonable costs incurred by Builder in connection with the storage, security and handling of such Owner Furnished Material during the period beginning on the date on which the same is delivered to Builder's shipyard and ending one (1) month prior the applicable delivery date contemplated by the OFE Delivery Schedule. All OFE shall be in a condition which does not increase Contractor’s cost or delay the progress of the Work. Any increase in Contractor’s cost or time of performance due to a failure to comply with this Section 2.1, including the timely delivery of the OFE, shall be treated as an event entitling Contractor to an equitable adjustment under Article 10 below. Owner shall retain payment obligations for OFE contracts, subcontracts or other items assigned by Owner to Contractor, if any; however, payments are not to be released without first providing Contractor prior notice and an opportunity to comment.
