Out of Warranty Repairs. Any services provided to You by Acer that are not within the scope of the Product Limited Warranty or that are not covered by an extended service plan are governed by this Agreement and are otherwise subject to the terms of the Acer out-of-warranty service procedures and any applicable service order. For a period of ninety (90) days after services are performed, Acer warrants that services provided by it were performed in a professional and workmanlike manner. If your problem recurs within the 90-day service warranty period, Acer will, at its option, (i) re-perform the services, (ii) replace the Product pursuant to the terms of this Agreement, (iii) permit You to return the Product and issue a refund pursuant to the terms of this Agreement, (iv) refund the amount You paid for the services. If You purchased an extended service plan from Acer or from a third party, please refer to the extended service plan for its coverage, duration and terms of service.
Out of Warranty Repairs. 3.1 Vendor will either repair or replace, at Newbridge's cost, defective Vendor Products not covered under warranty, within ten (10) working days of its receipt. Repair charges are available from Vendor's repair facility upon request. The warranty on serviced Vendor Products is ninety days measured from date of service. Out-of-warranty repair charges are based upon the prices in effect at the time of return.
Out of Warranty Repairs. With respect to repairs to equipment purchased by Buyer after the expiration of the Warranty Period specified above, CM-STS agrees to provide repair service at Buyer's expense on all equipment ordered hereunder. Equipment to be repaired under this section shall be returned by Buyer to CM-STS' facility in Hauppauge, New York (freight prepaid). Unless otherwise agreed upon, CM-STS will ship the repaired unit which shall meet the unit's established specifications within thirty (30) days (if materials are available within a reasonable time) after receipt of the defective unit. Repaired units will be warranted for ninety (90) days from due date of shipment. If equipment returned for repair is determined to be beyond repair, CM-STS will so notify Buyer and, if agreed to by Buyer, ship a replacement unit within a reasonable time of such agreement. The Buyer agrees to pay for such replacement unit, and it shall be warranted for one (1) year from date of shipment. If requested by the Buyer, CM-STS will take the necessary steps to dispose of unrepairable equipment. Transportation costs of equipment for repair will be borne by Buyer and units shall be adequately packed so as to prevent shipping and transportation damage. All transportation costs associated with the return of repaired and replacement equipment will be borne by the Buyer. CM-STS will provide support and repair service for the equipment supplied over the design life of the equipment as long as such repair service remains available from the applicable equipment vendor. Out of Warranty Repairs. 13.1. Smart Modular agrees to use commercially reasonable efforts to refurbish to a “like new” condition any Memory Module no longer covered by the express warranties set forth elsewhere in this Agreement (an “Out of Warranty Product”). Refurbishment prices shall be set at the time refurbishment is required and will not exceed 1.2X the then current material and conversion costs.
Out of Warranty Repairs. After expiration of the Warranty Period, Com21 will repair Com21 Products on a time and materials basis at prices and charges that are not higher than those provided by Com21 to third parties. Com21 will warrant such out-of-warranty repair of Com21 Products for a period of thirty (30) days from the date of repair. Distribution Agreement
Out of Warranty Repairs. Sanmina shall provide Advance Replacement services to purchasers of Products, who participate in Customer's annual support program ("Elastic Extended Warranty and Support Program" or other such program). Customer will pay Sanmina for all out of warranty repairs and out of warranty Advance Replacement in accordance with Exhibit A hereto under the caption "Spares and Replacement Pricing." Sanmina shall maintain levels of spare and replacement Parts and Products inventory sufficient to provide either next day shipment or same day premium service if requested by Customer, and shall maintain levels of repaired Products as agreed upon by both parties ("B STOCK"). Customer may monitor the levels of B Stock in the same manner as that provided in Section IX(B) for maintenance and reporting of inventory, and Sanmina agrees to limit or cease adding to B Stock inventory levels upon receipt of written instructions from Customer.
Out of Warranty Repairs. Repairable Integrated Products that are out of warranty and returned to Seller for repair will be repaired within 10 business days to Imperva or Imperva’s end customer. Third party faulty add-on cards shall be replaced and sent to their vendors for repair. Imperva will be charged for replaced parts cost plus [***] and two (2) labor hours per RMA at the agreed labor cost specified in the Additional Services table in Exhibit A. The parties shall agree within two years from the Effective Date about the number of spare units to be held by Seller for this purpose. Imperva shall be charged for the repair of out of warranty third parties add-on cards.
Out of Warranty Repairs. Subsequent to the expiration of the applicable warranty period, PINNACLE shall service and maintain the GenieDVE Product at a price to OEM equal to PINNACLE's standard out-of-warranty terms for so long as PINNACLE is generally servicing and maintaining its product similar to the GenieDVE Product.
Out of Warranty Repairs. 5.5.1. If during the Warranty Term Klas Telecom finds the Product to require repair due to damage not covered by this Agreement Klas Telecom shall provide a quote at its then current GSA rates for repair of the Product which shall include all associated shipping costs. Klas Telecom shall not be obliged to carry out any such repairs without first having accepted an order for same on the basis of the quote provided.
