NON-DISCRIMINATION/NON-HARASSMENT. 1. The Company and the Union agree that no employee covered by this Agreement shall be discriminated against or harassed on the basis of race, color, religion, national origin, ancestry, sex, age, disability, sexual orientation, veteran’s status or union support or non-support. Retaliating or discriminating against an employee for making a complaint about harassment is also prohibited. Violations of this Article will not be tolerated and may result in disciplinary action, up to and including termination of employment.

NON-DISCRIMINATION/NON-HARASSMENT. It is agreed by the Company and the Union, there shall be no unlawful discrimination/harassment against any present or futnre employee on the basis of race, religion, color, national origin, ancestry, physical disability, mental disability, legally protected medical condition (cancer-related or genetic characteristic or infonnation; pregnancy; childbirth, or related medical conditions), marital status, sex, gender identity or expression, sexual orientation, age over 40, veteran status, or any other basis protected by federal, state or local law. The Company further prohibits unlawful harassment based on the perception that anyone has any of those characteristics, or is associated with a person who has or is perceived as having any of those characteristics.
NON-DISCRIMINATION/NON-HARASSMENT. 12.1 The Employer and the Union agree that no employee shall be discriminated against or harassed on the basis of race, color, religion, national origin, age, sex, sexual orientation, disability, veteran status, or on any other basis prohibited by federal or applicable state law. The Employer and the Union further agree that a qualified employee with a disability who is able to perform the essential functions of his or her position or of a specific position, with or without reasonable accommodation, shall not be discriminated against on the basis of the disability. Notwithstanding the above, it shall not be a violation of this contract if a bona fide occupational qualification exists.
