List of Subcontractors. CONTRACTOR, within fourteen (14) days after execution of the Agreement, shall furnish to OWNER in writing, a list of all subcontractors, sub-subcontractors, materialmen and suppliers known to CONTRACTOR at the time, which will be performing labor or furnishing materials for the Authorized Work. CONTRACTOR agrees to supplement the list in writing as soon as additional subcontractors, sub-subcontractors and materialmen and/or suppliers become known. Subcontractors shall notify CONTRACTOR of any sub-contractors they plan to use on the Authorized Work and of any related-party relationships the subcontractor may have with the lower-tier subcontractors, which information CONTRACTOR shall provide to OWNER. The labor rates shall be forwarded to OWNER for review. Actual wages and benefits shall be used in calculating costs for Change Order(s). CONTRACTOR shall be required to fill out a labor rate exhibit in substantially similar format as the document attached as Exhibit A. CONTRACTOR shall provide documentation to support the rates CONTRACTOR, subcontractors and sub-subcontractors charge, including, by way of example, but not limited to union contracts and workers compensation rates. OWNER retains the right to adjust excessive charges for labor rates prior to commencement of work. OWNER and CONTRACTOR agree that under no circumstances shall OWNER be required to pay for labor rates charged in excess of the reasonable, customary and prevailing rate in the industry in the geographic area in which the work is performed. In the event that CONTRACTOR fails to timely submit planned labor rates for change orders, OWNER may at its discretion substitute the rates provided under this Agreement or the reasonable rates in the area for similar work subject to a 2% deduction. List of Subcontractors. Developers are required to submit a Subcontractors List for their Prime Contractor at the start of the project. As subcontractors are added to the project, the Developer is required to notify EOC by submitting an updated Subcontractors List within five (5) days of addition of subcontractor to the project.
List of Subcontractors. Contractor's list of approved Subcontractors for the performance of the Work, and each of the Subcontractor's license numbers, is set forth on Exhibit B. In the event Contractor desires to replace any Subcontractor pursuant to Section 4107 of the California Public Contract Code, then Contractor shall notify Authority in writing, and, Authority shall then follow the process set forth in Section 4107(a) of the California Public Contract Code. Thereafter, if requested by Authority in writing, Contractor shall provide Authority with a draft copy of its form subcontract, and disclose to Authority the name, trade, and subcontract amounts for each subcontractor prior to the proposed subcontractor's performance of any portion of the Work. Subcontractors shall have the required licenses and expertise necessary to perform the proposed subcontract work. Authority will promptly reply to Contractor in writing stating whether or not Authority, after due investigation, has reasonable objection to any such proposed person or entity. Provided Authority has not objected to the proposed subcontractor, such person or entity shall be deemed a "Subcontractor." Contractor shall not contract with a proposed person or entity to whom Authority has made reasonable and timely objection, or an entity that has been debarred by the DIR. If any contract between Contractor and a Subcontractor is materially altered so that it differs from the form subcontract provided to Authority with regard to terms other than (1) the description of the Work to be performed pursuant to the subcontract, and (2) the subcontract price, that subcontract shall be submitted to Authority for its review prior to the commencement of applicable portion of the Work.
List of Subcontractors. Contractor shall attempt to use Owner’s preferred Subcontractors, and Contractor’s pre-approved Subcontractors, identified in Exhibit N. If Contractor has difficulty using Owner’s preferred Subcontractors and Contractor wishes to use a Subcontractor other than those listed or agreed to by Owner, Contractor shall submit the name of the proposed Subcontractor to Owner’s Representative for his or her approval (such approval not to be unreasonably withheld). The Submittal shall contain the name, address, and contact person of the proposed Subcontractor, as well as a description of the Work to be performed. Owner’s Representative shall notify Contractor within five (5) Business Days if it objects to any proposed Subcontractor. Contractor shall identify a suitable substitute party in writing within ten (10) Business Days after it receives Owner’s disapproval of a proposed Subcontractor. If after choosing a Subcontractor to perform a portion of the Work, Contractor decides to terminate such Subcontractor or such Subcontractor no longer performs a portion of the Work, Contractor must notify and consult with Owner regarding any replacement Subcontractor.
