Jury and Court Duty. A regular employee shall be granted leave with pay and benefits when summoned as a juror or by subpoena or summons to attend as a witness at court. Any remuneration for jury duty or witness fees received by the employee shall be remitted to the College.

Such employees, so compensated, shall not be eligible to retain jury duty pay or witness fees and shall turn any such pay or fees received over to the Employer. If employees are excused from jury duty prior to the end of their work shift, they shall return to work as directed by the Employer or make arrangements for a leave of absence. Any absence whether voluntary or by legal order to appear or testify in private litigation, not in the status of an employee but as a plaintiff or defendant, shall not qualify for leave under this section and shall be charged against accumulated leave or be without pay.

Jury and Court Duty. 1. The Employer agrees that when Employees are required by law to serve as Jurors, those who actually serve shall be excused from work for those days on which they actually serve and shall be paid their regular salary for those days at their regular rate of pay.

An employee may be granted leave of absence when serving on a jury or when subpoenaed by proper authority to appear as a witness for a Federal Government, the State of North Dakota, or a political subdivision thereof. The leave of absence shall be only for the duration of the court or jury duty. The employee shall be granted time off with pay, less the amount of fees received for jury or court duty (which shall be turned into the Business Office at the Sports Center). Jury or court fees may be retained if the employee is on authorized personal leave or chooses to take a pay deduct. Employees should inform the building administrator as soon as notice of jury or court duty is received and request time off in the usual manner. Jury and Court Duty. If an advance notice of eight (8) hours is given to the Company, an employee called for jury service, or subpoenaed to appear as a witness, in a case in which he has no interest, on any regular work day shall be excused from his regular shift that day and be paid the difference between what they receive as a jury fee and eight (8) hours straight time pay. If an employee is excused from jury duty not later than four (4) hours into his scheduled shift on that day, he must work the remainder of his schedule that day in order to be entitled to the payment of said difference.
