Formal Step 1. As set forth in Section 3 above, the Union may bring a grievance directly to “formal step 1.” Within thirty (30) days (within ten (10) days to grieve a discharge) after the cause of the grievance is alleged or known to have taken place. Within five (5) work days of delivery of the written grievance, the appropriate manager or Director, the grievant and the President of the Union (or his designated representative) shall meet to resolve the grievance. Within one (1) week after that meeting, the appropriate manager or director shall deliver a written answer explaining his/her decision to the President of the Union, with a copy to the appropriate shop xxxxxxx/union representative and to the Manager, Labor Relations.

Formal Step 1. If the grievance is not resolved at the INFORMAL STEP and the EMPLOYEE desires to further pursue the matter through the grievance procedure, the EMPLOYEE and/or the appropriate UNION Representative shall reduce the grievance to writing utilizing the proper form, a sample of which is contained as Appendix 1 to this AGREEMENT. The grievance form shall be submitted to the second-level supervisor within five work days following the informal resolution decision by the first-level supervisor. The written grievance shall provide specific information with respect to the event giving rise to the grievance, identify specific provisions of regulations and/or the terms of this AGREEMENT which are alleged to have been violated and the corrective action desired. Only the issues presented at the INFORMAL STEP shall be considered at any successive steps. The second-level supervisor or designee shall meet with the EMPLOYEE and/or appropriate UNION Representative and such other individuals deemed necessary and render a written decision not later than five workdays following receipt of the grievance. A copy of the decision shall also be provided to the UNION at the same time.
Formal Step 1. If, in the judgment of the grievant, the grievance remains unresolved after the informal meeting with the supervisor, the grievant may, within ten (10) calendar days after the informal meeting response, file the written grievance with the building principal or department administrator on the Association’s grievance form. A meeting between the grievant, association representative, and the principal or department administrator will be at a time mutually agreed to in order to discuss and, if possible, resolve the written grievance. This meeting will be held within ten (10) calendar days from the principal or department administrator's receipt of the written grievance, and the principal or department administrator's written response will be given to the grievant within ten (10) calendar days thereafter. If the parties mutually agree that no meeting is needed, the principal or department administrator shall respond to the grievant and the Association in writing to the Step 1 written grievance within ten (10) calendar days of its receipt.

The Arbitrator's decision will be final and binding on all parties. The cost of arbitration shall be the responsibility of the party losing arbitration.

  • Step I 18.3.1.1 An employee may present the grievance orally either directly or through the Union representative to the immediate supervisor.
