Disciplinary Appearance Clause Samples
Disciplinary Appearance. When an employee is required to appear before the Administration and/or the Board regarding the discipline or dismissal of an employee, the employee shall be given written notice and be entitled to have a representative of the Union present.
Disciplinary Appearance. When an employee is required to appear before the Board or administration concerning any matter which could adversely affect that employee's position, employment or salary, the employee shall be given reasonable prior written notice of the reasons for such meeting and shall be entitled to have a personal representative at said meeting. If, during the course of discussing disciplinary action with an administrator, an employee requests Union representation, the administrator shall discontinue the discussion.
Disciplinary Appearance. With the exception of gross misconduct, an employee shall be given written notice if required to appear before the Board, Administration and/or Director of Buildings and Grounds regarding any investigation. If the employee reasonably believes that the outcome of the meeting will result in disciplinary action, the employee may request the presence of a Union representative.
Disciplinary Appearance. A teacher shall have the right to be accompanied by a Union representative at any meeting with the Board or an administrator, if at the time such meeting is called it is reasonably anticipated that disciplinary action against the teacher might occur at or as a direct consequence of such meeting. The affected teacher shall be given reasonable advance written notice of such meeting and the nature of the possible disciplinary action. In the event the representative chosen is other than a Union representative, the Union President shall be given notice of any disciplinary action taken or recommended within a reasonable time following such meeting unless otherwise mandated by law. Except where such delay shall possibly consequentially affect the investigation or possibly be detrimental to students or other employees, reasonable advance notice shall be at least twenty-four (24) hours.

When an administrator requires a meeting with a bargaining unit member for: (1) an investigatory conference from which the member has a reasonable expectation discipline might result; or (2) the purpose of communicating a recommendation for discipline, the member shall receive an email (or other written communication) informing him/her of the time and location of the meeting and of his/her right to have Union representation present. When the Board requires a meeting with a bargaining unit member, the member shall be given reasonable advance written notice of such meeting and the nature of the possible disciplinary action. A member shall have the right to be accompanied by a Union representative at any such meeting with the Board. In the event the representative chosen is other than a Union representative, the Union President shall be given notice of any disciplinary action taken or recommended within a reasonable time following such meeting.

If the Administration reasonably believes that the outcome of the meeting may result in disciplinary action, Administration will advise the employee of their right to have union representation present. If the employee believes that the meeting may result in disciplinary action, the employee has the right to request Union representation at which point Administration will not proceed further until such representations is present.

In emergency circumstances, such advance notice may be given orally to the employee and the Union President or designee.

Whenever a teacher is required to appear before the Board or an administrator for a meeting at which disciplinary action will be communicated, reasonable advanced written notice of such meeting and the nature of the possible disciplinary action shall be given. The teacher may be accompanied at such meeting, but must provide written advance notice of the name and title of any representative who will attend. In the event the teacher chooses someone other than a Union representative, the Union President shall be given notice of any disciplinary action taken within a reasonable period of time following the meeting.

Exceptions to the twenty-four (24) hours written notice requirement may be made depending on the nature of the misconduct. In emergency circumstances, such advance notice may be given orally to the employee and the Union President or designee.
