CONTINUITY OF WORK. It is a specific condition of employment pursuant to this Agreement that during the period that this Agreement is in force, all parties undertake to ensure that all industrial grievances and disputes shall be dealt with strictly in accordance with Clause 10 Avoidance of Disputes Procedure of this Agreement and that at all times the Refineries Operations will not be compromised due to any unlawful strike, ban or limitation, or any other form of unlawful industrial action.
CONTINUITY OF WORK. When the dispute is not settled at the first step or until a decision has been rendered at the second step (assignment of the work by the committee), any employee performing work over which there is a dispute shall continue to perform such work. However, from the time of the assignment of the work as decided by the committee at the second step, said assignment shall be upheld until the Tribunal administratif du travail has rendered a decision, in such case.
CONTINUITY OF WORK. Pending the completion of the procedure set out in this clause work shall continue without interruption. No party shall engage in provocative action and pending the resolution of the dispute the status quo shall apply. The rights of individuals or parties shall not be prejudiced by the fact that work has continued under this process normally and with out interruption.
CONTINUITY OF WORK. 31:01 During the lifetime of this agreement, the Union agrees there will be no strikes, slowdowns or picketing, or any other similar act which will interfere with the regular schedule of work; and the Employer agrees there will be no lockout. CONTINUITY OF WORK. The work of each day or shift shall be continuous with the customary break for a meal.
CONTINUITY OF WORK. The contract shall not mean continuity of work for the Contractor. The Contractor shall contact the authorised representatives of FACT for obtaining instructions. The instructions given over telephone have also to be complied with.
CONTINUITY OF WORK. It is expressly understood and agreed that the services to be performed by the employees covered by this Agreement, pertain to and are essential to the operations of a public utility, and to the welfare of the public dependent thereon, and in consideration thereof, and of the agreements and conditions herein by the Company to be kept and performed, the Union agrees that the employees covered by this Agreement will not be called upon or permitted to cease or abstain from the continuous performance of the duties pertaining to the positions held by them with the Company, in accord with the terms of this Agreement. The Union further agrees that it will take every reasonable means which are within its powers to induce employees who are members of the Union and subject to its discipline who may engage in a strike or work stoppage in violation of this Agreement to return to work promptly. The Company agrees, on its part, to do nothing to provoke interruption of, or prevent such continuity of performance of said employees, insofar as such performance is required in the normal and usual operation of the Company’s properties. Any dispute over matters in violation of the terms of this Agreement must be handled in the manner provided by the Grievance and Arbitration Procedure as set forth in Article IV below. To provide for no disruption in work when a third party dispute arises between an employer other than FPL (contractor for services), and a Union(s) other than System Council U-4, the Company shall ensure there are proper gates through which employees may enter or leave Company property without directly encountering any form of job action by an outside Union. Gates shall be clearly identified for FPL employees only.
CONTINUITY OF WORK. 35.01 It is understood and agreed that the employees and Union covered by this Agreement do not have any rights individually or collectively to call or engage in a strike, work stoppage, or slowdown, or otherwise interfere by concerted action in any way with the expeditious accomplishments of assigned work or the public purposes for which the Bonneville Power Administration has been established, or condone any such activity by failing to take affirmative action to prevent or stop it.
CONTINUITY OF WORK. The Contractor should note that due to seasonal closure of some units and other variations in the quantity and nature of the work available to any on time it is not possible for the Council to guarantee continuity of work. The Council will issue orders on a random day to day basis. OMBUDSMAN COMPLAINTS The Contractor should be aware that his actions could be subject to investigation by the Local Government Ombudsman if a complaint were made about work that had been undertaken on behalf of the Authority under the terms of this contract. The Contractor will be required to fully co-operate with the Local Government Ombudsman including the provision of information and production of all documents and attendance of witnesses relevant to the investigation on the same basis as that applying to a Local Authority under the provisions of the Local Government Act 1975 and at no additional cost to the Authority. The Authority reserves the right in addition to any other right it may have under this Contract that where the Ombudsman finds maladministration and injustice as a result of fault of the Contractor, to recover from the Contractor any costs incurred by the Authority including any payments made to the complainant in respect of such fault. CONTINUITY OF WORK. It is agreed that there will be no stoppages, bans or limitations on work and all disputes shall be dealt with in accordance with the Avoidance of Dispute procedure. An exception may apply on the grounds of a bonafide safety issue, in accordance with the WA OSH Act 1984.
