Quality of Work. Consultant agrees that all Services performed under this Agreement will conform to the specifications of the College, be free from errors, and be of professional quality according to applicable industry standards. Upon notice by the College, Consultant will promptly correct any defects without charge to the College unless the request is considered new work by both parties.
Quality of Work. In the event that the CITY determines that the CONTRACTOR’s work is not to Specifications, or the work cannot be reasonably completed by the CONTRACTOR during the period specified, the CITY may at its option provide the CONTRACTOR ten (10) days written notice to remedy said default. In the event that the CONTRACTOR has not rectified said default within said ten (10) days, the CITY may at its option terminate this agreement. In the event of said termination, the CITY may at its option employ another contractor to complete the Project, and the CONTRACTOR shall indemnify and hold the CITY harmless from any and all damages it sustains as a result of the CONTRACTOR’s failure to perform.

Quality of Work. No Advance or any portion thereof shall be made with respect to defective work or to any contractor that has performed work that is defective and that has not been cured, as confirmed by the report of the Construction Consultant, but Lender may disburse all or part of any Advance before the sum shall become due if Lender believes it advisable to do so, and all such Advances or parts thereof shall be deemed to have been made pursuant to this Agreement.

The Tenant Improvements shall be constructed in a first-class workmanlike manner using only good grades of material and in compliance with the Final Plans, all insurance requirements, applicable laws and ordinances and rules and regulations of governmental departments or agencies and the rules and regulations adopted by Landlord for the Building.
Quality of Work. Contractor shall execute the Work with a quality of workmanship consistent with first-class public university projects. Contractor warrants that all Materials shall be new unless otherwise called for in the Contract Documents and that the Work will be free from defects and conform to the Contract Documents’ requirements.

Landlord shall supervise the construction of the Leasehold Improvements in conformance with the Construction Drawings and shall use its diligent good faith efforts to cause same to be constructed and installed in a good and workmanlike manner in accordance with good industry practice.

In rating this factor, attention should be paid to the consequences of poor quality work. Is the employee’s work neat, accurate, thorough, and acceptable? Must the work be redone, thus reducing the potential volume of acceptable work which could have been produced? Do errors in the employee’s work affect the efforts of others? Does poor work reflect adversely upon the school, department, or District?
