OEM Software definition

OEM Software means NetApp proprietary Filer operating system and related software or firmware used in the OEM Products.
OEM Software means versions of Liquid Audio Reference Software as modified for OEM Products.
OEM Software means OEM's proprietary products as listed in the applicable Sales Order.

  • It is explicitly agreed that OEM may bundle or integrate the Software with the OEM Software only and in no way may the Software be bundled with or integrated in any other product whatsoever.

  • The End Customer licenses for the Software shall permit the End Customer’s use of the Software only (i) for View and Design OEM’s, as part of the Bundled Software, with data access limited to the OEM Software Data, (ii) for Multiple Datasource OEM’s, as part of the Bundled Software, with OEM Software Data as well as additional Datasources, in each case limited to the Business Scope.

  • IMG will have the right to market and distribute the Base Software Products and OEM Software Products under IMG trademarks, under VERITAS trademarks, under third party trademarks, or, if agreed, co-branded with VERITAS' and IMG's trademarks.

  • OEM Software shall be limited to the computer You obtained it with.

  • Each Software Product shall be either a Base Software Product, an OEM Software Product or an Application Software Product.

  • Licensees shall indemnify, defend, and hold harmless Licensors and their directors, officers, agents, employees, members, subsidiaries and successors in interest from any claim, liability and expense, including reasonable attorneys' fees, arising out of Licensee's exceeding the scope of the License and the permissions granted hereunder with respect to Licensees' use of the OEM Software including, but not limited to, Licensees' continuing to use the OEM Software beyond the Term of this Agreement.


More Definitions of OEM Software

OEM Software means the OEM Software identified in Exhibit A.
OEM Software shall also refer, where applicable by context, to the Integrative Code and to such other software which OEM may develop from time to time hereunder as part of its operations/financials software products.
OEM Software means OEM's proprietary software products with which the Software is licensed to be bundled under this Agreement.
OEM Software means any one or more of the computer programs in object code form listed in Schedule A2 as of the Effective Date and such additional programs as Changepoint and OEM hereinafter may agree to in writing by the amendment of Schedule A-2 and includes Upgrades thereto made generally available by OEM to its customers. The term "OEM Software" shall also refer, where applicable by context, to the Integrative Code and to such other software which OEM may develop from time to time hereunder as part of its operations/financials software products.
OEM Software. Software applications owned or licensed by third parties and acquired by or licensed to BHS from such third parties, including, without limitation, the software applications of the Supported Platforms. OEM PRODUCTS: Hardware and OEM Software. PERMITTED USES: Uses of the Applications within the BHS Facilities (or within the BHS Affiliates Facilities solely by means of Web browser technology) by Permitted Users solely in the conduct of the business of providing healthcare services to patients of the BHS Facilities and not to process the data of any third parties.
OEM Software means the OEM’s (or its licensors) own software as specified in the Order Form; Order Form: a written quotation by ▇▇▇▇▇▇▇▇▇▇ to the OEM for the supply of the Software and any Ancillary Services; Paninsight: means Paninsight Limited as detailed in the Order Form; Paninsight Promotional Material: the advertising and promotional material provided by Paninsight to the OEM from time to time (as the same may be updated from time to time); Services: means the Support Services and any Ancillary Services; Software: means the software modules of Paninsight specified in the Order Form; Sourcing Issue: an inability on the part of Paninsight to source particular materials or resources on terms similar or identical to those available at the Effective Date (including due to exchange rate fluctuations, increases in taxes or duties) or a change in applicable law; Support Services: the support services provided by ▇▇▇▇▇▇▇▇▇▇ as more particularly described in the Support Terms; Support Terms: has the meaning given to it in clause 5.1; Term: the term of this Agreement as more particularly detailed in clause 15.1; Third Party Data: all documents, information, designs, images, content, software, works, data, databases and materials of any kind and in any medium which are licensed to the OEM and accessed by the Software;

Related to OEM Software

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Supplier Software means software which is proprietary to the Supplier and software which is or will be used by the Supplier for the purposes of providing the Placement Services;

  • System Software means machine-readable data and executable programs used to define the functionality of the HPS control system and standard hardware products, but does not include firmware, operating system, application software or other software products.

  • Custom Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Custom Software.

  • Customer Software means software which is owned by or licensed to the Customer, including software which is or will be used by the Supplier for the purposes of providing the Goods and/or Services but excluding the Supplier Software;
