Font Software definition

Font Software means the software provided by Branding with Type which, when used on an appropriate Device or Devices, generates typeface and typographic designs and ornaments. Font Software shall include all bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades, updates, related files, permitted copies, permitted conversions, and related documentation.

Font Software means coded software that is accompanied by this Agreement or that You are about to order online and which generates typeface designs when used with the appropriate hard- and software, plus any and all other data including documentation provided with such software.

Font Software means the software developed and produced by Optimo which, when used with the appropriate hardware and software, allows for the generation of the typographic characters (fonts) available on Optimo’s website. “Licensed Fonts” shall mean the typographic characters (fonts) purchased by you as specified in your purchase order (the “Order”). Rte des Acacias 43 CH–1227 Genève The License authorizes you to install and use the Font Software on one or sev- eral storage medium(s) (the “Licensed Unit”) for one or several specific use(s) as defined below in Article 2 (“Permitted License Uses”). The Licensed Unit(s) and the Permitted License Use(s) covered by the purchased License are specified by the Licensee when placing his/her Order. By downloading and/or installing the Font Software, you confirm that you have read and understood the terms and conditions of this Agreement and that you expressly agree with them without reservation.

• You may not: Transfer your license rights in the Font Software, except as expressly provided herein.

• You are bound by the Agreement and you ac- knowledge that all use of the Font Software supplied to you by Storm Type Foundry for the purposes set forth under this Agreement is gover- ned by this Agreement.

• In the event your Use of the Font Software exceeds your licensed amounts, you agree to license from Storm Type Foundry the necessary additional amounts and pay any fee associated with such increase.

• You may transfer all your rights to use the Font Soft- ware to another person or legal entity provided that (i) the transferee accepts and agrees to be bound by all the terms and conditions of the Agreement, (ii) you destroy all copies of the Font Software, including all copies stored in the memory of a hardware device and (iii) there is no change to the intent or scope of the rights granted by this Agree- ment as a result of such transfer.

• To make a warranty claim, you must notify Storm Type Foundry in text form within the Warranty Period, which could in- clude via an email to xxxxx@xxxxxxxxx.xxx and provide sufficient infor- mation regarding your licensing of the Font Software so as to enable Storm Type Foundry to verify the existence and date of the transac- tion.

The Font Software remains and shall remain, now and in the future, the property of Lineto GmbH. Lineto GmbH is the sole owner of copyrights and the exploitation rights for the Font Software. The Licensee agrees that the Font Software and documentation, and all copies thereof, are owned by Lineto GmbH; and its design, structure, or- ganization and encoding are valuable property of Lineto GmbH and/or its suppliers. The Licensee agrees that the Font Software and documentation are protected by Swiss copyright law and Swiss trademark and design patent laws, by the copyright and trademark laws of other countries, and by inter- national treaties (regardless of whether the Font Software is registered in the relevant register or not). In addition, the Licensee agrees to treat the Font Software in the same manner corresponding to other copyrighted and trademark-protected pro- ducts, e.g. books. With the exception of the points explicitly mentioned here, copying the Font Software is not permitted. Any and all copies that the Licensee is permitted to produce on the basis of this agreement have to contain the same copyright, trademark and other property clauses as those on or contained in the Font Software. The Licensee declares not to modify, adapt or translate the encoding of the Font Software, nor reproduce, decompile, disassemble, reverse-engineer, change, modify or otherwise attempt to reveal the source code of the Font Software. The Licensee also agrees to use the trademarks that are connected to the Font Software, accordingly to accept usage of the trademarks (including the identification of the owner of the respective trademark). Trademarks can be used solely for the purpose of identifying printed data from the Font Software.
