Font Software definition
Font Software means the software provided by Branding with Type which, when used on an appropriate Device or Devices, generates typeface and typographic designs and ornaments. Font Software shall include all bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades, updates, related files, permitted copies, permitted conversions, and related documentation.
Font Software means coded software that is accom- panied by this Agreement or for which You are about to purchase a license and which generates typeface designs when used with the appropriate hard- and software plus any and all other data including documentation provided with such software.
Font Software means the software developed and produced by Optimo which, when used with the appropriate hardware and software, allows for the generation of the typographic characters (fonts) available on Optimo’s website. “Licensed Fonts” shall mean the typographic characters (fonts) purchased by you as specified in your purchase order (the “Order”). The Licensed Unit(s) and the Permitted License Use(s) covered by the purchased License are specified by the Licensee when placing his/her Order. By downloading and/or installing the Font Software, you confirm that you have read and understood the terms and conditions of this Agreement and that you expressly agree with them without reservation.

Any copies that you are expressly permitted to make pursuant to this Agreement must contain the same copyright, trademark, and other proprietary notices that appear on or in the Font Software.
In the event your Use of the Font Software exceeds your licensed amounts, you agree to license from The Type Founders, LLC dba Xxxx Xxxxxxxx Type the necessary additional amounts and pay any fee associated with such increase.
Although use of the Trademarks is not required, if you elect to do so, you may use the Trademarks (i) in your advertising, publicity, literature, packaging and other promotional activities in connection with the Font Software incorporated into your products or materials, and (ii) to identify the Font Software that is/are embedded in or accessed through your products or materials as permitted by this Agreement.
Account means your account at the The Type Founders, LLC dba Xxxx Xxxxxxxx Type website through which you purchased the Font Software license that is subject to the terms of this Agreement.
Transfer your license rights in the Font Software, except as expressly provided herein.

Font Software. (hereinafter “Font”): Any font in any digital format.
Font Software have identical meanings in this agreement. They are defined as the designs of the Fonts and the Software identified on Your Sales Receipt that produces a typeface design(s) together with any other artworks that may be associated with the Font.
Font Software is used for “Font”, “The Typeface”, “The Software”, or any combination thereof.
Font Software. (“Fonts”) is the desktop font software (OTF files) specified on your sales receipt and the typeface designs and concepts embodied by that font software as well as any media, documentation, updates, or artwork that may be associated with the Fonts now or in the future.

Additionally, Lineto GmbH is the sole owner of copyrights and exploitation rights for the Font Software. The Licensee agrees that the Font Software and documentation, and all copies thereof, are owned by Lineto GmbH. The design, structure, organisation and encoding of the Font Software and documentation are property of Lineto GmbH and/or its suppliers. The Licensee agrees that the Font Software and documentation are protected by Swiss copyright, trademark and design patent laws, as well as copyright and trademark laws of other countries and also by international treaties (regardless of whether the Font Software is registered in the corresponding registry or not). With the exception of the points explicitly mentioned within this XXXX, copying the Font Software is not permitted. Any and all copies that the Licensee is permitted to produce on the basis of this agreement, must contain the same copyright, trademark and other property clauses as those on or contained within the Font Software. The Licensee declares not to modify, adapt or translate the encoding of the Font Software, nor reproduce, decompile, disassemble, reverse-engineer, change, modify or otherwise attempt to reveal the source code of the Font Software. The Licensee also agrees to use the trademarks that are connected to the Font Software accordingly and to accept usage of the trademarks, including the identification of the owner of the respective trademark. These trademarks may only be used for the purpose of identifying the Font Software. Upon full payment of the agreed-upon usage fee, Lineto GmbH permits the Licensee the non-exclusive, non- transferable, non-sublicensable right and licence, subject to the terms and conditions of this XXXX and the “Specific Use Licence” (SUL).
