Fiserv Information means: (A) confidential plans, information, research, development, trade secrets, business affairs (including that of any Fiserv client, supplier, or affiliate), and other proprietary material of Fiserv that is marked with a restrictive legend, or if not so marked with such legend or is disclosed orally, is identified as confidential at the time of disclosure (and written confirmation thereof is promptly provided to Client); and (B) Fiserv's proprietary computer programs, including custom software modifications, software documentation and training aids, and all data, code, techniques, algorithms, methods, logic, architecture, and designs embodied or incorporated therein (whether or not any such information is marked with a restrictive legend).
Fiserv Information means the following types of information of Fiserv and its Affiliates obtained or accessed by Client from or on behalf of Fiserv or its Affiliates in connection with this Agreement or any discussions between the parties regarding new services or products to be added to this Agreement: (A) trade secrets and proprietary information (including that of any Fiserv client, supplier, or licensor); (B) client lists, information security plans, business continuity plans, all information and documentation regarding the Deliverables, all software Products (including software modifications and documentation, databases, training aids, and all data, code, techniques, algorithms, methods, logic, architecture, and designs embodied or incorporated therein), and the terms and conditions of this Agreement; (C) any personally identifiable information, defined as information that can identified to a particular person without unreasonable effort, such as the names and social security numbers of Fiserv employees; and (D) any other information and data received from or on behalf of Fiserv or its Affiliates that Client could reasonably be expected to know is confidential.
Fiserv Information means: (a) confidential plans, information, research, development, trade secrets, business affairs (including that of any Fiserv customer, supplier, or affiliate), and other Fiserv proprietary material; and (b) Fiserv’s proprietary computer programs, including custom software modifications, software documentation and training aids, and all data, code, techniques, algorithms, methods, logic, architecture, and designs embodied or incorporated therein (whether or not any such information is marked with a restrictive legend).
Examples of Fiserv Information in a sentence
Client agrees that any performance information, analysis, or program benchmark test results shall be considered Fiserv Information and shall not be disclosed in violation of Section 3 of the Agreement or without Fiserv’s prior written consent.
Fiserv software documentation and training aids marked with a restrictive legend shall be considered as Fiserv Information within the context of this Section 6.
Fiserv Information shall be and remain, as between the Parties, the property of Fiserv.

More Definitions of Fiserv Information
Fiserv Information means the following types of information provided to or accessed by Client in connection with this Agreement: (A) confidential plans, information, research, development, trade secrets, business affairs (including that of any Fiserv client, supplier, or affiliate), and other proprietary material of Fiserv that is marked with a restrictive legend, or if not so marked or is disclosed orally, is identified as confidential at the time of disclosure (and written confirmation thereof is promptly provided to Client); (B) Fiserv’s information security plans, business continuity plans, proprietary computer programs (including custom software modifications, software documentation, databases, and training aids, and all data, code, techniques, algorithms, methods, logic, architecture, and designs embodied or incorporated therein), all copyrights, patent rights, trademark rights and other proprietary rights which form part of the Fiserv Services, and the terms and conditions of this Agreement (whether or not any such information is marked with a restrictive legend); and (C) any information and data received from Fiserv that Client reasonably ought to know is confidential (whether or not any such information is marked with a restrictive legend).

Fiserv Information. For purposes of this Agreement, “PII” is defined as personally identifiable information that is not otherwise publicly available. Information is personally identifiable if it can reasonably be linked to a particular person, computer, or device, such as the name(s), address, telephone, account, and social security numbers, including password/authentication information, of Client’s individual customers or either party’s employees or contractors. PII does not include information reasonably believed to be made publicly available and information that is often made public; however, where an individual has directed that the information not be made public (e.g., an unlisted phone number or address) or the information has been obtained from the individual rather than a public source, it should not be considered publicly available. “Information” does not include any information that: (1) Recipient already possesses without obligation of confidentiality, develops independently without reference to Discloser’s Information, or rightfully receives without obligation of confidentiality from a third party; or (2) is or becomes publicly available without Recipient’s breach of this Agreement. (ii) “Client Information” means Information for which the Discloser is Client or its Affiliates.
